Chap. 279.—An ACT to amend and re-enact an act approved January
21, 1886, entitled an act to authorize the establishment of a ferry
across James river, at Columbia, Fluvanna county, Va., &c.
Approved March 1, 1886.
1. Be it enacted by the general assembly of Virginia, That
the act approved January twenty-first, eighteen hundred and
eighty-six, entitled an act to authorize the establishment of a
ferry across James river, at Columbia, from the depot of the
Richmond and Alleghany railroad to a convenient point on
the opposite side of the river, be amended and re-enacted so
as to read as follows: That the county courts of the counties
of Fluvanna and Cumberland, notwithstanding anything con-
tained in sections thirteen and twenty-three of chapter sixty-
four of the Code of eighteen hundred and seventy-three, in-
hibiting the establishment of a ferry within a half mile of an
established ferry, be and they are hereby authorized to estab-
lish a ferry across James river at Columbia, Fluvanna county,
from a point on the north bank of said river opposite or near
to the depot of the Richmond and Alleghany railroad, to a
convenient point on the south bank of said river, other than
the landing of the existmg ferry across said river at Columbia;
and upon such application and proceedings as are presented in
sections twenty-three to thirty-three inclusive, of chapter fifty-
two of the Code of eighteen hundred and seventy-three, the
county court of Cumberland may establish such landing on
said south bank as is above indicated, and a road leading
therefrom to the road now leading to the landing of the said
existing ferry: provided, however, that unless the Richmond
and Alleghany railroad company shall make, or unite in mak-
ing the application to said courts, its rights of property and
franchises as to any land on the north side of said river, pro-
posed to be used as a landing or as a road from said landing
to the public street or streets of Columbia, shall not be invaded
or so used without the consent of the said railroad company,
which consent it is hereby authorized to give.
2. The application and proceedings for establishment of said
ferry shall be in accordance with the provisions of sections
twelve, thirteen, fourteen and fifteen, of chapter sixty-four of
the Code of eighteen hundred and seventy-three, but the ap-
plicant need not be the owner of the lands proposed to be used
for the landings on either side of the river, and the notices
hereby required may be published for one month instead of
two. |
3. All acts and parts of acts in conflict with this act are, as
to the purposes and objects of this act, hereby repealed.
4. This act shall be in force from its passage.
