Chap. 249.—An ACT to repeal an act entitled an act providing for a
new Board of Visitors for the University of Virginia, approved
April 14th, 1882, and to amend and re-enact sections 2, 4 and 5, of
chapter 80 of the Code of 1873.
Approved February 26, 1886.
1. Be it enacted by the general assembly of Virginia, That
the act entitled an act providing for a new board of visitors of
the university of Virginia, approved April fourteenth, eighteen
hundred and eighty-two, be and the same is hereby repealed.
2. That sections two, four and and five of chapter eighty of
the Code of eighteen hundred and seventy-three; be and the
same are hereby amended and re-enacted, so as to read as fol-
lows: |
§ 2. The governor, between the first day of January, eigh-
teen hundred and eighty-six, and the first day of March, eigh-
teen hundred and eighty-six, shall, by and with the consent of
the senate, appoint nine persons as visitors of the said univer-
sity, three of whom shall: be from the division of the state in
which the university is located, and two from each of the other
grand divisions of the state. The term of office of all such
members shall commence on the first day of May, eighteen
hundred and eighty-six. - The terms of office of four such mem-
bers (one from each grand division of the state) to be designa-
ted by the governor at the time of their appointment, shall ex-
pire on the twenty-eighth day of February, eighteen hundred
and eighty-eight, and the terms of office of the other five shall
expire on the twenty-eighth day of February, eighteen hun-
dred and ninety. The governor, during the sixty days pre-
ceding the days when the term of office of the several members
of the board expire by limitation as aforesaid, shall, by and
with the consent of the senate, appoint, to fill the vacancies so
to be occasioned, persons whose terms of office shall in all cases
be for four years from that day. And thereafter, during the
sixty days preceding the days when the term of office of the
several members of the board will expire by limitation as afore-
said, the governor, by and with the consent of the senate, sh4ll
appoint, to fill the vacancies so to be occasioned, persons whose
terms of office shall be for four years from the day their imme-
diate predecessors’ terms expired. Vacancies occasioned other-
wise than by the expiration of the term of office, shall be filled
by the governor for the unexpired term, subject to the con-
firmation or rejection of the senate at its next session. The
members of the board shall always be apportioned among the
several grand divisions of the state, as first herein indicated;
and the members shall in all cases hold over after the expira-
tion of their terms of office until their successors are appointed
and qualified. °
§$ 4. The board of visitors shall meet at the university at least
once a year, and at such other times as they shall determine,
the days of meeting to be fixed by them; but the board first
appointed under this act shall meet at least once between the
first day of May, eighteen hundred and eighty-six, and the
twenty-ninth day of June,.eighteen hundred and eighty-six.
The board, at their first meeting after the first day of May,
eighteen hundred and eighty-six, and at their first meeting after
the twenty-eight day of February in every fourth year there-
after, shall appoint from their own body a rector, who shall pre-
side at their meetings. At the same time they shall appoint’a
secretary to the board. In the absence of.the rector or secre-
tary at any meeting, the board may appoint a president or sec-
retary pro tempore, and vacancies in the office of rector or of
secretary may be filled by the board for the unexpired term.
Special meetings of the board may be called by the rector or
any three members. In either of said cases notice of the time
of meeting shall be given to every other member, and five
members shall constitute a quorum for the transaction of busi-
ness. . .
§ 5. At every regular annual meeting of the board, they shall
appoint an executive committee, for the transaction of business
in the recess of the board, consisting of three members, to serve
for the period of one year, or until the next regular annual
meeting, whose duty it shall be to meet at the university at least
two days before the regular annual meeting of the board, and
on some day not later than the fifteenth day of, October in
every year.
3. The present board of visitors shall continue to act and dis-
charge their duties as such until the first day of May, eighteen
hundred and eighty-six, and thereafter until their successors
are appointed and qualified.
4. This act shall be in force from its passage.
