Chap. 243.—An ACT to authorize the authorities of the city of Win-
chester to establish water-works, and to incur a débt for that pur-
pose. )
Approved February 26, 1886.
1. Be it enacted by the general assembly of Virginia, That
it shall be lawful for the common council of the city of Win-
chester to submit to the qualified voters. of said: city, at such
time as the common council shall see fit, the question of in-
creasing the water supply of said city, or changing the same,
in such manner as the common council shall see fit; and at
such election the vote shall be by ballot, and the ballots con-
taining the words for water supply, shall be counted as in favor
of the scheme, and those containing the words against water
supply, shall be counted against the scheme: provided, how-
ever, that a favorable vote upon the question so submitted
shall not be regarded as compelling the common council to
adopt any particular scheme, or any scheme at all. But no
scheme shall be adopted that has not first been submitted to
and reported on by a board of commissioners, who shall be
elected by the common council for.that purpose. The members
of this board shall not be members of the common council, and
in the event of the adoption of a scheme, it shall be carried out
under the supervision of the said board; but this board shall
report to and be responsible to the common council.
2. In the event that at least three-fifths of the votes cast
shall be for water supply, and the common council shall adopt
some scheme for that purpose, it shall be lawful for the com-
mon council to increase the debt of the city of Winchester be-
ond that now authorized by law to a sum not exceeding twenty
thousand dollars, and to cause the bonds of the city of Win-
chester to be issued, to an amount necessary to carry out
said scheme, but not exceeding said sum of twenty thousand
dollars. Said bonds shall have coupons attached, representing
interest on the principal thereof, not exceeding six per centum
per annum, and payable semi-annually. These bonds shall be
known as water-bonds, shall be so designated on their faces,
and the proceeds of the water rates shall be set apart—first, to
pay the interest thereon, and a proper sinking fund to be estab-
lished by ordinance of the common council.
3. This act shall be in force from its passage.
