Chap. 240.—An ACT to amend and re-enact sections 3 and,8 of an
act approved March 7, 1884, entitled an act to amend and re-enact
the charter of the town of North Danville, as amended by an act
approved August 23, 1884.

1. Be it enacted by the general assembly of Virginia, That
sections three and eight of an act approved March seventh,
eighteen hundred and eighty-four, entitled an act to amend and
re-enact the charter of the town of North Danville, as amended
and re-enacted by an act approved August twenty-third, eigh-
teen hundred and eighty-four, be amended and re-enacted so
as to read as follows:
§ 3. The said town of North Danville, and the inhabitants
thereof shall be exempt from all county levies, road-tax, poor-
tax, school-tax, or taxation in any form by the county of Pitt-
sylvania, except as hereinafter provided; and it shall keep its
own streets, and the public roads running through it in goed
order and repair, and shall provide for its own poor, and levy
and collect its own school-tax, sufficient in amount to maintain
its own schools in compliance with the laws of the state respect-
ing education: provided, this act shall not be so construed as
to relieve the property of the citizens of said town of North
Danville from a just proportion of taxation for the payment of
the bonded debt of the county of Pittsylvania, incurred on ac-
count of the subscription to the Lynchburg and Danville rail-
road company. And it shall be the duty of the conamissioner
of the revenue of North Danville to furnish annually to the
board of supervisors of said county, a certified copy of the com-
missioner’s land and property-books of the said town, within
thirty days after the completion of said books for purposes of
state taxation; and the said board of supervisors shall, at the
time of making their annual levy, ascertian the amount of
money necessary to be raised in the said town to meet accruing
instalments for the discharge of said debts, and shall certify the
same to the council and the collector of said town, who shall
cause the said amount of money to be levied upon the real and
personal property and income as shown by the land and pro-
perty-books of said town of North Danville. And it shall be
the duty of the said collector to collect within the time provided
by law for the collection of state taxes, and pay over said amount
to the treasurer of said county to be by him paid out according
to the directions of the said board of supervisors; and said col-
lector shall, on the first day of December of each year, make
up a statement of all moneys so collected by him, verify the
same by affidavit, and deliver it to the clerk of the board of
supervisors within fifteen days thereafter, and at the same time
pay to the county treasurer the amount so collected. On or
before the fifteenth of June of each year said collector shall pay
over to the treasurer of said county the amount so collected by
him up to that time, and each year, at the regular annual meet-
ing of the board of supervisors, he shall make his final settlement
with them, furnishing a statement of all moneys collected by him
on account of levies and penalties since his last settlement with
said board, and furnishing certified copies of the lists of insol-
vents and delinquents for state taxes passed upon and allowed
by the said town council at the period, and in the mode pre-
scribed by law. If the said commissioner of the revenue shall
fail to perform any of the duties required of him in this section,
a fine shall be imposed on him of not less than twenty-five nor
more than one hundred dollars, and ten dollars additional for
each period of ten days he shall fail to perform any of said
duties. And for said default he shall be subject to indictment
and trial in the county court of Pittsylvania. And if the said
collector shall fail to discharge any of the duties herein enume-
rated, he shall forfeit his commissions on all sums collected as
aforesaid, and also be liable to be proceeded against on his
official bond, along with his sureties, by the county of Pittsyl-
vania, in the circuit court thereof, by motion, action-in-law, or
suit in equity. And provided further, that this act shall be so
construed as to authorize and require the levy, collection and
payment, by the said town of North Danville, of her just pro-
portion of the amount necessary to pay the bonded debt of the
county of Pittsylvania, incurred on account of the subscription
to the Lynchburg and Danville railroad company, for the year
eighteen hundred and eighty-four, as well as succeeding years.
And in the event the said county shall be unable to enforce
payment thereof, by or of said collector and his sureties, the
circuit ‘court of Pittsylvania shall have jurisdiction of any pro-
ceedings by motion, action-at-law or suit in equity by said county
against said town to enforce payment of the same; and no act
of limitations in favor of said town shall run during the pro-
gress of any proceedings against said collector and his sureties.
And said town of North Danville shall have power to sue and
be sued, and to enter into contracts by its corporate name.
§ 8. The council of said town shall have all powers which are
now or may hereafter be vested by law in the council, or mayor
and council, of towns of less than five thousand inhabitants, ex-
cept that the councilmen shall not have the powers of justices
or conservators of the peace. They shall have, specifically,
powers to lay and collect taxes on such property, business and
professions, and such other subjects of taxation as are or ma
be taxed by the state: provided, that the rate of taxation shall
not exceed, for any one year, in addition to the school tax and
the tax levied on account of the debt of the county of Pittsyl-
vania, mentioned in this act, one hundred cents for each one
hundred dollars of the assessed value of real and personal prop-
erty, on such property as is assessed and assessable, and the
poll tax shall not exceed fifty cents for each male taxable per-
son in any one year. The council shall have power, also, to
fix fines and penalties for the violation or non-performance of
the town ordinances, which shall be collected by warrant before
the mayor, or one of the justices of said town, and to provide
for imprisonment in case of non-payment of fines.
2. This act shall be in force from its passage.
