Chap. 140.—An ACT to authorize the County of Madison to sub-
scribe to the stock of the’ Madison Court-house and Orange Rail-
road, on certain conditions.
Approved February 16, 1886.
1. Be it enacted by the general assembly of Virginia, That
it shall be lawful for the county court of Madison county to
make an order requiring the sheriff, not earlier than the fourth
Thursday in May, and not later than the second Tuesday in
November, eighteen hundred and eighty-six, at a time desig-
nated in said order, nor less than thirty days from the date
thereof, to open polls and take the sense of the voters of said
county on the question, Whether the said county shall subscribe
to the stock of the Madison Court-house and Orange railroad
company, to an amount not exceeding fifty thousand dollars,
for the said county, in bonds of the said county, bearing in-
terest at six per centum per annum, and to be paid in the man-
ner now provided by law for the payment of such subscrip-
tions; but the said subscriptions are to be subject to the condi-
tion that such bonds, for one-half of the amount so subscribed,
are to be delivered to the said company only when the work of
building the said road shall be so far advanced that its road-bed
shall be completed and in readiness to receive iron rails on every
part thereof; and the residue of the said bonds is to be so de-
livered when the said road shall be fully completed and equip-
ped for the regular transportation of freights and passengers.
2. The said election shall be conducted, and the ballots cast
thereat shall be counted, returned and canvassed, in the man-
ner prescribed in chapter sixty-one of the Code of eighteen
hundred and seventy-three.
3. If it shall appear, by the report of the board of commis-
sioners appointed to count the said ballots, that three-fifths of
the qualified voters of the said county, voting upon the ques-
tion, are in favor of the subscription, and that said three-fifths
includes a majority of the votes cast by freeholders at such
election, and a majority of all the registered voters of the said
county, the said county court shall, at its next session, enter an
order requiring the supervisors of the county to attend, on a
day and at a place named in the order, to carry out the wishes
of the voters, as expressed at said election.
4. This act shall be in force from its passage.
