Chap. 95.—An ACT to provide for filling a vacancy in the office of
Attorney-General.

_ 1. Be it enacted by the general assembly of Virginia, That
if at any time when the general assembly is not in session, a
vacancy should for any reason occur in the office of attorney-
general, it shall be the duty of the treasurer, auditor of pub-
lic accounts, and the second auditor, or a majority of them,
to elect some fit and competent person to be the attorney-
general, which election they shall certify to the governor,
who shall cause a commission to be duly issued to him. The
person so elected shall hold the office until the end of the
term of the attorney-general in whose place he was chosen,
or until thirty days after the next session of the general
assembly, whichever shall happen first. Should such vacancy
occur during the session of the general assembly, it shall be
filled by the joint vote of the two houses; and when a
vacancy in the office of attorney-general has been filled when
the general assembly was not in session, in accordance with
the provisions of this act, it shall be the duty of the general
assembly at its next session by a vote of the two houses, to
elect a fit person to be attorney-general, for the residue of the
term that has so become vacant.
2. All act or parts of acts in conflict with this act, are
hereby repealed. :
3. This act shall be in force from its passage.
