Chap. 54.—An ACT to amend and re-enact an act entitled an act
directing the board of visitors of the Virginia Military Institute to
be vacated, and the appointment of a new board, approved March 38,
1882.
In force November 18, 1884.
1. Beit enacted by the general assembly of Virginia, That
sections two, three, and fourteen of the Code of cightcen bhun-
dred and seventy-three, as amended by an act entitled an act
directing the board of visitors of the Virginia military insti-
tute to be vacated, and the appointment of a new board, be
amended and re-enacted so as to read as follows:
§2. That the board of visitors of the Virginia military
institute, be and the same is hereby declared vacant, and it
shall be the duty of board of public works of Virginia, imme-
diately upon the passage of this act, to appoint a new board
of visitors for-the said institute, which board shall consist of
nine members, three of whom shall be selected from the
division of the state in which the institute is situated, and two
from each of the other three grand divisions of the state. The
term of office for the board of visitors shall be three years,
commencing on the first day of January next after their
appointment, except that the term of office of the members
of said board first appointed under this act, shall begin on
the fifteenth day of December, eighteen hundred and eighty-
four, and continued for three years from and after January
first, eighteen hundred and eighty-five. Five members of
said board shall constitute a quorum. They shall be and are
hereby declared to be a corporation, and as such may sue and
be sued, for any cause or matters which have heretofore
arisen, as well as for any cause or matter which may here-
after arise.
§3. The board of visitors appointed under this act, shall
meet at the institute on the fifteenth day of December, eigh-
teen hundred and eighty-four, or as soon thereafter as practi-
cable, and proceed to reorganize said institute as the board
may deem right and proper. They shall fix the salaries of
the professors and officers, and may in their discretion,
remove any officers heretofore elected or appointed in said
institute, and may remove at will, for good and sufficient
cause, any officer who may be appointed under this act; but
no order to remove a professor shall be made without the
concurrence therein, of a majority of the whole number of
visitors, and the board shall forthwith communicate to the
governor a full statement of the reasons on which the removal
was made.
§ 14. The board after the first meeting under this act, shall
meet at the Virginia military institute, or at other places
than the institute, when in their opinion it shall be necessary
to do so. A meeting shall be held annually at such time as
may be designated for their annual meeting in their last reso-
lution on the subject. A meeting may also be called at any
time by the adjutant-general or superintendent of the insti-
tute, when either may deem it advisable, and the board may
adjourn from time to time.
2. This act shall be in force from its passage.
