Chap. 3.—An ACT to amend and re-enact sections 8 and 8 of an act
approved March 7, 1884, entitled an act to amend and re-enact the
charter of the town of North Danville.
Approved August 23, 1884.
1. Be it enacted by the general assembly of Virginia, That
the third and eighth sections of the act entitled an act to
amend and re-enact the charter of the town of North Dan-
ville, approved March seven, eighteen hundred and eighty-
four, be amended and re-enacted so as to read as follows:
§ 3. The said town of North Danville, and the inhabitants
thereof, shall be exempt from all county levies, road tax, poor
tax, school tax, or taxation in any form by the county of
Pittsylvania, except as hereinafter provided; and it shall
keep its own streets, and the public roads running through it,
in good order and repair, and shall provide tor its own poor,
and levy and collect its own school tax, sufficient in amount
to maintain its own schools in compliance with the laws of
the state respecting education: provided that this act shall
not be so construed as to relieve the property of the citizens
of said town of North Danville from a just proportion of tax-
ation for the payment of the bonded debt of the county of
Pittsylvania, incurred on account of the subscription to the
Washington City, Virginia Midland and Great Southern rail-
road. And it shall be the duty of the town council of North
Danville to furnish annually to the board of supervisors of
said county, a certified copy of the commissioner's land and
property books of the said town, within thirty days after the
completion of said books for purposes of state taxation, and
the said board of supervisors shall, at the time of making their
annual levy, ascertain the amount of money necessary to be
raised in the said town, to meet the accruing instalments for
the discharge of said debts, and shall certify the same to the
mayor and council of said town, who shall cause the said
amount of money to be levied, collected, and paid over to the
treasurer of the county, to be by him paid out according to
the directions of the said board of supervisors; and in the
event there should be a failure to levy, collect, and pay said
money, or any part thereof, to the said treasurer prior to the
time at which the semi-annual interest on said debt falls due,
then it shall be the duty of the treasurer of said county to
collect said money from the inhabitants of said town, in the
same manner as by law taxes are collected, and when col-
lected, to be paid out by him as hereinbefore directed: and
provided further, that this act shall be so construed. as to
authorize and require the levy, collection, and payment by
the said town of North Danville of her just proportion of the
amount necessary to pay the bonded debt of the county of
Pittsylvania incurred on account of the subscription to the
Washington City, Virginia Midland, and Great Southern
railroad for the year eighteen hundred and eighty-four, as
well as succeeding years. And said town of North Danville
shall have power to sue and be sued, and to enter into con-
tracts LM its corporate name.
§ 8. The council of said town shall have all powers which
are now or may hereafter be vested by law in the council, or
mayor and council of towns of less than five thousand inhab-
itants, except that the councilmen shall not have the powers
of justices or conservators of the peace. They shall have
specifically powers to lay and collect taxes on such property,
business, and professions, and such other subjects of taxation
as are or may be taxed by the state: provided that the rate
of taxation shall not exceed for any one year, in addition to
the school tax, one hundred cents for each one hundred dol-
lars of the assessed value of real and personal property, on
such property as is assessed and assessable, and the poll tax
shall not exceed fifty cents for each male taxable person in
any one year. The council shall have power also to fix fines
and penalties for the violation or non-performance of the town
ordinances, which shall be collectable by warrant hefore the
mayor or one of the justices of said town, and to provide for
imprisonment in case of non-payment of fines.
2. This act shall be in force from its passage.
