Chap. 200.—An ACT to incorporate the town of Clifton Forge in the
county of Alleghany.
Approved December 1, 1884.
1. Be it enacted by the general assembly of Virginia, That
the town of Clifton Forge in the county of Alleghany, as the
same has been or may be laid off into lots, streets, and alleys,
shall be and the same is hereby made a town corporate by
the name of Clifton Forge, and by that name shall have and
exercise all the powers, rights, privileges and immunities, and
be subject to all the provisions of chapter fifty-four of the
Code of Virginia of eighteen hundred and seventy-three, as
they now exist or may hereafter be enacted so far as the
same relates to towns of less than five thousand inhabitants,
and are not in conflict with the terms of this act.
2. That the boundaries of said town shall bé as follows:
Beginning at the Carding mill dam, thence in a straight line
to C. M. Berger's slaughter house; thence along county road
to point opposite east end of Chesapeake and Ohio caboose
tracks; thence to Jackson’s river; thence crossing same to
county road on south side of said river; thence along said
county road to a point on hill opposite the stone bridge across
Mill creek; thence to said bridge.
3. There shall be seven trustees of said town, who shall be
qualified voters of the town. They shall compose the coun-
cil thereof, and five of them shall constitute a*quorum for the
transaction of business. They shall hold their offices for four
years, and until their successors are elected and qualified.
Said trustees shall be chosen by ballot on the fourth Thurs-
day in May, eighteen hundred and eighty-five, and every
fourth year thereafter, and shall enter upon their duties on
the first day of July succeeding their election. Any person
entitled to vote in the county of Alleghany for members of
the general assembly, and who has been a resident for three
months in the corporate limits of the town of Clifton Forge,
shall be entitled to vote at all elections under this act. The
council shall appoint three qualified voters of said town, one
of whom shall act also as clerk, to hold said election between
the hours of eight ante meridian and four post meridian.
Said three-judges of election shall decide any contest with
reference to the right to vote of any individual, and shall
count the ballots, and in case it is impossible to determine the
seven who have the highest number of votes by reason of a
tie, the said clerk shall by lot determine the matter in the
presence of his associates, and of not more than two persons
selected by each candidate affected by said lot. Said three
judges of election shall determine who have received the
greatest number of votes in such olection, and shall certify
the same and an abstract of the votes on the poll-books, and
return the same, together with the ballots, to the clerk of the
council, to be by him preserved, and said clerk shall imme-
diately thereafter make up and return to each of the persons
elected, a certificate of election. :
4. The council shall at their first meeting in July of each
year, elect one of their own number to be mayor of said town,
and also one of their number who shall be clerk of said coun-
cil; and shall also appoint a town, sergeant, who shall bea
resident of said town. Said council shall require such bonds
from said officers in such pen<ies as said council may deter-
mine, conditioned for the faithful, performance of their duty,
and shall have power by a two-thirds vote, to remove the
same from office at any time. All the officers of the corpora-
tion shall serve without compensation, except as hereinafter
provided. Said council shall appoint its own time of meet-
ing, and may fill any vacancy arising in their own body for
the unexpired term. The bonds herein provided for, shall be
executed with security to be approved by the council, and
shall be filed with the clerk.
5. The said council shall have power to pass all by-laws
and ordinances necessary for the proper government of said
town, not in conflict with the constitution and laws of the
state of Virginia, and the constitution and laws of the United
States, and to punish the violation of same by fine and im-
prisonment; to mark accurately the bounds of existing
streets, and to lay off new streets, alleys and sidewalks: pro-
vided however, that no street, alley, sidewalk, or crossing
lace shall be so laid off as to cross the tracks or yards of the
hesapeake and Ohio railway company, or the Richmond
and Alleghany railroad company, save and except at the
points where said tracks are now crossed by the located and
established streets, roads, and highways now marked out and
aid off.
6. The said council may annually levy a tax for corpora-
tion purposes, which on no property shall exceed fifty cents
on the one hundred dollars’ valuation, except that on the pe-
tition of freeholders representing three-fourths of the value of
all real estate within the corporation, the council may levy a
corporation tax, not to exceed the amount named in the said
petition. Said tax upon property herein authorized, shall be
only upon such subjects of taxation by the state of Virginia
as are assessable and assessed for state taxation within the
county of Alleghany, and shall in all cases be based upon the
assessment made by the officers of the state for the state tax-
ation.
7. The said council shall have the power to impose a license
tax, not exceeding ten dollars, upon all persons within said
town, on whom the state has imposed a license tax: provided
however, that they may impose a further tax, of not less than
twenty dollars nor more than two hundred dollars, on all
liquor dealers, and on all handlers of liquor as a beverage, and
keepers of bowling alleys, billiard or bagatelle tables.
8. No license shall be granted to any person or persons,
club or corporation, to sell wine, ardent spirits, malt liquors,
or any mixtures thereof, alcoholic bitters, or fruits preserved
in ardent spirits, either by wholesale, retail, or to be drank at
the place where sold, or in any other way, within the corpo-
rate limits of said town, or within one mile thereof, without,
unless and until the applicants shall have produced to the
court, or officer authorized to grant such license, the written
consent of the council of said town.
9. The mayor shall preside at all meetings of the council
when present, but shall have only his own vote as a member
of said council, and in the absence of the mayor, a president
pro tempore may be elected by the meeting. The mayor
shall have and exercise the jurisdiction and authority of a
justice of the peace of Alleghany county, within the corporate
limits of said town, and within one mile of the limits of said
corporation, and shall be entitled to the same fees.
10. The clerk shall keep a correct record of the proceed-
ings of the council; shall provide the books and stationery
therefor; make out the certificates of election; make out a
list of the property to be taxed, real and personal, within the
limits of the corporation, and fix the. valuation of the same
as determined by the officers of the state for state taxation;
shall issue tickets for taxes voted by the council, which tickets
he shall deliver to the sergeant when ordered by the council;
and shall have power to administer the oaths of office to any
of the town officers. The clerk shall also discharge such
other duties as may be devolved upon him by the council
under the powers herein conferred on them; and for his ser-
vices shall be allowed such sum as said council shall deter-
mine to be proper.
11. The sergeant shall be ex-officio treasurer of said town;
shall execute such bonds and give such security as the council
shall prescribe; shall receive all moneys belonging to the
town, and shall disburse the same by such authority and in
such manner as the council shall determine, and shall exhibit
at such times and before such persons as they may designate,
who shall audit the same, a statement of his transactions as
the financial officer of the town, together with the vouchers
therefor. The said sergeant shall be vested with all the
powers of a constable within the limits of said town, and
shall be a conservator of the peace, with power to arrest in
said town, or anywhere within Alleghany county, upon a
warrant issued by the mayor, any person charged with a
violation of the laws or ordinances of said town; and he shall
have power upon a like warrant to arrest anywhere in Alle-
ghany county any person charged with the commission of any
crime in said town, or within one mile of its corporate limits.
When a violation of the laws or ordinances of said town is
committed in his presence, he shall have authority and power
forthwith to arrest the offender and carry him before some
conservator of the peace of said town, to be dealt with ac-
cording to law.
12. The mayor and sergeant of said town, shall have power
and authority to deputize any number of the citizens of the
town, and citizens of said county who may be in said town,
to assist the sergeant in the full discharge of his duties in all
cases of riots, misdemeanors, and other offences, when, in
their judgment, the emergency requires it.
13. Every citizen of said town, who is liable therefor, shall
be exempt from the payment of any road tax or district tax
whatever, and from any county capitation tax: provided
that the council of said town shall impose a capitation tax of
one dollar upon every such citizen to be devoted exclusively
to free school purposes within the limits of said town.
14. The following named persons, residents and qualified
voters within the corporate limits of said town, to-wit: W. C.
Moody, M. H. Ham, J. A. Ford, T. P. Bowles, George W.
Huddleston, J. G. Woodward, and J. F. Hughes, are hereby
declared and appointed trustees of said town of Clifton Forge,
and may qualify before any magistrate or justice of the peace
in the county of Alleghany; and thereupon they shall consti-
tute the council of said town, and as such shall have and ex-
ercise all the powers granted to said council, and shall dis-
charge all the duties thereof, until their successors shall be
duly elected and qualified.
15. This act shall be in force from its passage.
