Chap. 192.—An ACT directing the Auditor of Public Accounts to sus-
pend proceedings against the sureties of George S. Cady, late sheriff
of Culpeper county.
Approved December 1, 1884.
Whereas it is represented that a judgment obtained in be-
half of the commonwealth against George 8. Cady, and
against Fayette Browning et als., his sureties, was rendered
under circumstances that prevented the said sureties from
making defence and establishing the credits; and whereas it
is claimed by said sureties that they, ten or more years ago,
paid the amount actually due the commonwealth by the said
Cady and his sureties, and the said sureties are prepared to
show, by competent evidence, that they are not properly
chargeable with any balance, as now demahded by the com-
monwealth of them through its officers: therefore,
1. Be it enacted by the general assembly of Virginia, That
the first auditor is hereby directed to suspend proceedings
against the said sureties for the collection of the claim afore-
said, and to make such settlement with said sureties as shall
appear to be just, upon the evidence to be produced by the
said sureties, as though the said judgment had not been ren-
dered; and in making such settlement he will exonerate said
sureties from all damages included in said judgment. And
he will accept from said sureties, in satisfaction of any bal-
ance found to be due by them, any bonds, at their par value,
of this state, issued under act approved February fourteen,
eighteen hundred and eighty-two. The settlement authorized
under this act shall be made prior to the first day of January,
eighteen hundred and eighty-six, and the provisions of chap-
ter three hundred and one of the Acts of Assembly, passed
March seven, eighteen hundred and eighty-four, are hereby
suspended as to the judgment herein recited.
2. This act shall be in force from its passage.
