Chap. 17.—An ACT to amend and re-enact sections 4, 8, 9, and 10 of an
act approved March 4, 1884, to provide for the working of roads and
repairing bridges in the county of Scott.
Approved August 26, 1884.
1. Be it enacted by the general assembly of Virginia, That
sections four, eight, nine, and ten of an act approved March
the fourth, eighteen hundred and eighty-four, be amended and
re-enacted so as to read as follows:
§ 4. That the commissioner of roads shall have charge of
all the roads in his magisterial district. His duty shall be to
see that all the roads in his district are kept in good condition
and are of the proper width. He shall examine the roads in
his district in the months of April and November in each year,
and see that the roads and bridges are keep in good repair;
and if he shall find any contractor delinquent he shall give
him notice in writing, and on failure to comply with the law
or his contract, shall make necessary repairs and force pay-
ment therefor as provided for in this act. But if upon such
examination he shall find that such contractor has executed
his contract or performed “his duty according to law or his
contract, he shall give him a certificate to that effect, with a
statement showing the amount such contractor is entitled to
have offset against his road tax, such certificate to be given
before the time fixed for the collection of said tax; and where
work has been done by any person other than a contractor,
under the direction of the commissioner, it shall be the duty
of such commissioner to give a like certificate. The compen-
sation of said commissioner shall be one dollar and fifty cents
per diem for each day in which he may be actually engaged
in discharging his duties under the provisions of this act, and
to be — by the board of commissioners of roads for the re-
spective magisterial districts: provided that- the compensa-
tion of commissioners shall not for any one year exceed
thirty dollars. And should a vacancy occur in any district
for commissioner of roads by failure to qualify, death, resig-
nation, or otherwise, it shall be the duty of the supervisor of
said district to discharge the duties of commissioner of roads
until such vacancy is filled, and the supervisor thus acting
shall be entitled to receive the same compensation for each
day of actual service as is allowed by this act to the commis-
sioner of roads.
§8. That if any section remain unlet by reason of there
being no bidder, or the amount offered be unjust, the com-
missioner of roads of the district may let the same by private
contract, the contract price not to exceed that estimated by
the district road board; and no supervisor of said county,
commissioner of the revenue, or justice of the peace therein,
or other persons authorized to make contracts for the work-
ing of any of the roads thereof, shall be in any way interested
in any contract provided for in this act, and any violation of
this provision shall render the contract null and void; and
should any commissioner of said county, or any person acting
as such, fail to make a suitable contract, either public or
private, for the working of any section of his district, it shall
e the duty of such commissioner, or any person acting as
such, to appoint some responsible person residing within the
bounds of said section, as overseer of the same, and it shall be
the duty of the overseer to take charge of the said section
and proceed to have the same worked and repaired as pro-
vided for by law, and according to the means at his disposal.
And it shall be the duty of the commissioner of roads, or any
person acting as such, to furnish the overseer thus appointed,
with a list of names of all persons liable to work on said sec-
tion, and the said overseer shall have all the powers given
to a contractor, as to requiring said persons to work on aail
section and the collection of fines. The term of service for
an overseer shall be one year from the date of his appoint-
ment; he shall be entitled to such compensation as the dis-
trict road board may allow, not exceeding one dollar per day
for each day of actual service. He shall not be required to
give bond, but may be subject to indictment by the grand
jury, and fined not less than five nor more than fifty dollars
for failure to discharge his duty according to law.
§ 9. For the purpose of providing a fund for working roads
and repairing bridges in the county of Scott, it shall be the
duty of the board of supervisors of said county, not later
than the fifteenth day of June in each year, to fix such rate
and levy such tax on all real and personal property in each
district in said county as in its judgment will be necessary
to keep all the roads and bridges in good repair: provided
that said levy shall in no year excved fifteen cents on the one
hundred dollars.
§10. The board of road commissioners for each district
shall certify to the board of supervisors on or before the fif-
teenth day of June in euch year, the amount that in its opin-
ion will bo necessary or proper to be apent in its road dis-
trict for the ensuing year, and the rate of tax that should be
levied upon the real and personal property in said district,
and the board of supervisors shall certify to the commissioner
of the revenue the rate fixed, and the amount necessary to
be raised upon each district, respectively, and he shall extend
the taxes against all property and persons in the distnct
levied for road purposes.
2. This act shall be in force from its passage.
