Chap. 139.—An ACT in relation to fences in Berkley District in the
county of Spotsylvania.
Approved November 27, 1884.
_ Whereas by an act of the general assembly approved Feb-
ruary twenty-seven, eighteen hundred and seventy-two, the
county court of Spotsylvania, was authorized to rescind an
order theretofore made adopting the provisions of an act enti-
tled an act relating to fences, and for the protection of crops,
passed January twenty-sixth, eighteen hundred and sixty-
six; and whereas by an act approved March twenty-five,
eighteen hundred and seventy-two, a general law was passed
regulating the mode and manner in which the provisions of
said act passed January twenty-sixth, eighteen hundred and
sixty-six, in relation to fences, and for the protection of crops,
might be repealed and abrogated in such counties or parts
of counties as had adopted the same; and whereas the county
court of Spotsylvania has recently made and adopted an
order repealing the provisions of the said act of the twenty-
sixth day of January, eighteen hundred and sixty-six, in
Berkley district of Spotsylvania county, which had been
theretofore adopted for the said district or township in
accordance with the provisions of the law; and whereas a
doubt having arisen as to whether the said act of February
twenty-seventh, eighteen hundred and seventy-two was not
repealed by the act approved March twenty-fifth, eighteen
hundred and seventy-two, and the said order of court based
thereon invalid; and whereas a large number of citizens of
the said district have petitioned the general assembly to set
aside and declare invalid the said order of the county court
of Spotsylvania; therefore,
1. Be it enacted by the general assembly of Virginia, That
the order entered by the county court of Spotsylvania, de-
claring the provisions of the act passed January twenty-
sixth, eighteen hundred and sixty-six, which had been
adopted for Berkley district in said county, to be rescinded
and inoperative, be and the same is hereby declared null and
void, and any change in relation to the law of enclosures in
said district, shall be made in accordance with the provisions
of the general law relating to that subject as set.out in the
said act approved March twenty-fifth, eighteen hundred and
seventy-two. |
2. This act shall be in force from its passage.
