Chap. 122.—An ACT to amend and re-enact section 34, chapter 118,
Code of 1878, limiting the time for contesting wills to two years.

1. Be it enacted by the general assembly of Virginia, That
section thirty-four, chapter one hundred and eighteen of the
Code of Virginia of eighteen hundred and seventy-three,
limiting the time for contesting wills, be amended and re-
enacted so as to read as follows:
§ 34. A court may, however, without summoning any party,
proceed to probate, and admit the will to record or reject the
same. After a sentence or order under this section, a person
interested, who was not a party to the proceeding, may,
within two years, proceed by bill in equity to impeach or
establish the will, on which bill a trial by a jury shall be
ordered to ascertain whether any, and if any, how much of
what was so offered for probate be the will of the decedent.
If no such bill be filed within that time the sentence or order
shall be forever binding.
