Chap. 69.—An ACT to amend section 6, chapter 56 of the Code of
1873, relating to the Condemnation of Lands.

1. Be it enacted by the general assembly of Virginia, That
section six of chapter fifty-six of the Code of eighteen hun-
dred and seventy-three, be amended and re-enacted so as to
read as follows:
6. If the president and directors of a company incorpo-
rated for work of internal improvement, the court of a county,
or the council of a town, cannot agree on the terms of pur-
chase with those entitled to lands wanted for the purposes of
the company, county or town, five disinterested freeholders
shall be appointed by the court of the county or corporation
in which such land, or the greater part thereof shall lie (any
three of whom may act), for the purpose of ascertaining a
just compensation for such land, and if the county or town
in which said work of internal improvement is proposed to
be constructed is a subscriber to the stock of said company,
it shall be lawful for the courts of the county or corporation,
upon the application of said company, or the owners of the
land, to select the said freeholders from some other county
or town than that in which said work of internal improve-
ment is proposed to be constructed.
2. This act shall be in force from its passage.
