Chap. 51.--An ACT to convey the title of the Commonwealth to cer-
tnin Lands in the county of Elizabeth City upon certain conditions, to
the Trustees of the Hamnmpton Norman and Agricultural Institute.

Whereas the board of cducation invested the sum of nine
theusand five hundred dollars of the land script fund, being
a part of the purchase money for the same. in the purchase of
a certain tract of land in the county of Thizabeth City, and
fully set forth and described ina certain deed of Tazewell
Tavlor, Charles K. Mallory and Thomas Tabb. special com-
missioners to the commonwealth of Virginia, bearing date the
twenty-first day of October, eighteen hundred and seventy-
three, and duly recorded in the clerk’s office of the county
eourt of Elizabeth City county, the said land to be held) by
the commonwealth for the use and benefit of the Hampton
Normal and Agricultural Institute, the balance of the pur-
chase money for said tract of land having been supphed by
the said institute; and whereas it was expressly provided in
the said convey ance, that in the event of the withdrawal of
the said fund by the commonwealth of Virginia from the said
Hampton Normal and Agricultural Institute, for any cause
whatever, the said land in that event to become the property
of the said the Hampton Normal and Agricultural Institute
upon the payment of the said sum of nine thousand five hun-
dred dollars to the commonwealth of Virginia; and whereas
the trustees of the Hampton Normal and Avricultural Insti-
tute desire to have the legal title of the said land vested in
the said corporation, for the uxe and benefit of the said the
Hampton Normal and Agricultural Institute, it being to the
interest of the said institute to have the legal title so vested,
and are willing perfectly to secure the sum “ot nine thousand
five hundred dollars, so that the same will be promptly paid
to the commonwealth whenever the said fund, or any part
thereof, may, for any cause, be withdrawn from the said the
Hampton Normal and Agricultural Institute; therefore,
1. Be it enacted by the general assembly of Vi irginia, That
the governor of this commonwealth is hereby authorized and
requested to convey, by a good and sufficient deed, to the
trustees of the Hampton Normal and Agricultural Institute,
the title held by the commonwealth in the said) tract or
parcel of Jand located in the county of Elizabeth City, con-
taining seventy-one and four-tenths acres, and fully set forth
and described in the said deed of Tazewell Taylor, Charles
K. Mallory, and Thomas Tabb, special commissioners to the
commonwealth of Virginia, dated twenty-tirst day of October,
eighteen hundred and seventy-three.
2. When the said deed is delivered to the trustees of the
Hampton Normal and Agricultural institute, the governor
will receive from the said trustees of the Hampton Normal
and Agricultural Institute, a decd of trust, duly executed for
record, conveying unencumbered real estate in the county of
Elizabeth City, to secure to the commonwealth of Virginia,
the payment of the said sum of nine thousand five hundr ed
dollars, whenever the same or any part thereof may be de-
manded by the commonwealth of Virginia, or the board of’
education; the said real estate so conveyed to be of ample
value to secure the said sum of nine thousand feve hundred
dollars, and to be so certified by the county judve of the
county of Elizabeth City. and the said security to be ap-
proved by the board of education.
