Chap. 501.—An ACT declaring vacant the office of superintendent of
schools in certain cases, and to make it unlawful for the board of
education to appoint when the senate is not in session, any person as
superintendent of schools, who has previously been rejected by the
senate.

e 1. Be it enacted by the general assembly of Virginia, That
the office of superintendent of public free schools and the
office of city superintendent of schools, in any of the coun-
ties or districts or cities of the commonwealth, shall be
deemed vacant in the following cases, and upon the happen-
ing of any one of the following events: the refusal of the
senate to confirm his nomination, his death, resignation, or
removal from the county or city, for which he was appointed
such superintendent, the expiration of his term of office, or
his removal from office by competent authority.
2. It shall not be lawful for the board of education, or the
» governor, during the periods when the senate is not session,
, to appoint as school superintendent, for any county or city
of this commonwealth, any person who having been pre-
viously nominated by anid board, for the position of superin-
tendent of schools has been rejected by the senate.
3. This act shall be in force from its passage.
