Chap. 493.—An ACT to authorize tho common council of the city of
Petersburg to adopt a system of sewerage for said city, &c.
Approved March 17, 1884.
1. Beit enacted by the general assembly of Virginia, That
the common council of the city of Petersburg, in addition to
the powers conferred on them by the charter of said city, be
and -they are hereby empowered to adopt by a vote of two-
thirds of all the members of said council, taken by yeas and
nays and recorded, a system of sewerage for said city, and
from time to time, as in the opinion of two-thirds of all the
members of said council, expressed by a vote taken by yeas
and nays and recorded, the public necessities may require, to
order the construction of sewers in accordance with the
system so adopted.
2. That in all cases where, according to the system of
sewerage adopted as aforesaid, sewers are to be located on
private property, and the city cannot by agreement obtain
title to ground necessary for the purpose, it shall be lawful
for the city to apply to and obtain from the circuit or corpo-
ration court of said city, authority to condemn the same,
which authority shall be applied for and proceeded in as pro-
vided by law.
3. That the said common council be, and they are hereby
authorized and empowered, by a vote of two-thirds of all the
members thereof, taken by yeas and nays and recorded, to
fix and determine what proportion, if any, of the expense of
constructing said sewers shall be paid out of the public trea-
sury, and what proportion of such expense shall be appor-
tioned between the city and real estate owners benefitted by
the construction of said sewers.
4. That nothing contained in the twelfth section of chapter
three of the charter of said city shall limit the powers of the
common council under this act.
5. This act shall be in force from its passage.
