Chap. 466.—An ACT for the relief of the estate of George W. Hender-
‘ lite, and for the relief of his sureties.
Approved March 17, 1884.
Whereas Georre W. Henderlite, deceased, late treasurer of
Smyth county, died indebted to the commonwealth of Vir-
ginia in the sum of five thousand six hundred and seventy-
seven dollars and forty-eight cents, on account of the state
revenue for the year eighteen hundred and seventy-cight, with
interest thereon from ‘the first day of August, ciehteen hun-
dred and seventy-nine, in the sum of seventy dollars. on
account of the Moffett revister taux, with interest thereon
from the first day of December, eighteen hundred and
keventy-erght; and in the further sum of eight hun-
dred and seventy dollars and twenty-five cents, with in-
terest thereon from the first day of June, eighteen) bhun-
dred and seventy-nine; and whereas the said Henderlite
was brought to a sudden and untimely death, whereby many
of his papers and evidences of debt and vouchers were lost,
and others were rendered valueless in the hands of his ad-
ministrator; and whereas the estate of the said Henderlite is
largely indebted and insolent; and whereas G. D. H. Killin-
ger, A. T. Harwilt, E. R. Depp, W. A. Faris, J. C. Killinger,
D. E. James, Georse S. Smith, Daniel Lindamood, J.C. An-
derson, J. A. Harris, Daniel A. Kee, John Faris, G. D. Smith,
J. F. Scott, S. J. James, W. M. Williams and R. K. James
are sureties on the official bond of said Henderlite, of date
June twenty-first, cighteen hundred and seventy-five, and are
in very moderate pecuniary circumstances, and the collection
of all of the said sum for which they are bound would greatly
embarrass and impoverish them and their families; and where-
as a petition in this matter was filed in the circuit court of
Smyth county in accordance with the law in such cases
made and provided, which, together with the record accom:
panies the bill, and by whic hit appears that all the state-
ments in this preamble have been conclusively proven, and
relief recommended by the Judge of the said circuit court of
said county ; therefore,
1. Beit enacted by the general assembly of Virginia, That
the estate of George W. Henderlite and the sureties atoresaid
on his official bond be forever released from the damages for
which they are now liable on account ot’ said indebtedness:
provided the said sureties shall, in the circuit court of the
city of Richmond, within six months from the passage of
this act, confess judyment to the commonwealth of Virginia
for the principal sum due from the estate of said Henderlite,
as above specified, with interest as above specified ; but no
execution shall issue upon said judement until after the ex-
piration of two years from the date of said judgment, and
not then, if the after provisions of this act are complied
with.
2. That the auditor of public accounts be and he is hereby
authorized and directed toaccept in payment of the said indebt-
edness and of the judgment aforesaid, from the personal rep-
resentative of said Henderlite, or from the sureties aforesaid,
or any or either of them, at any time within two years from
the confession of judgement aforesaid, bonds of the common-
wealth of Virginia issued or to be issued under the act of’ as-
sembly approved February fourteen, eighteen bundred and
cighty-two, at their par or face value for the amount of the
principal sum upon which judgment has been confessed, and
whenever said bonds, at any time within the said two vears,
are so tendered and acecpted for the principal sum and in-
terest, as aforesaid, it shall be in full satistaction of all diabil-
ity of said estate and of said sureties on account of the in-
debtedness aforesaid, and shall be in full satisfaction and dis-
charge of the judgment aforesaid.
3. This act shall be in force from its passage.
