Chap. 463.—An ACT to amend the 18 section of chapter 126 of the
Code of 1878, in relation to assets in hands of personal representatives.
Approved March 17, 1884.
1. Be it enacted by the general assembly of Virginia, ee
section thirteen of chapter one hundred and twenty-six 0 the
Code of eighteen hundred and seventy-three, be and He same
is horeby amended and re-enacted so as to read as follows:
§ 13. It shall be the duty of every personal representative
to administer well and truly the whole personal estate of his
decedent. The appointment of a debtor executor, shall not
extinguish the debt. When the powers of a personal repre-
sentative of a decedent shall cease, and an administrator de
bonis non has qualified, it shall be lawful to pay and deliver
to such administrator de bonis non, the assets of the estate of
the decedent, whether converted or not, for which the first
personal representative is responsible, and said administrator
de bonis non shall administer the same, and his receipt there-
for shall be a voucher, pro tanto in the scttlement of the ac-
count of the former personal representative. But nothing
herein contained shall be construcd as changing the existing
law in reference to suits against the said former personal re-
presentative, or as authorizing a suit against him or his es-
tate, by the administrator de bonis non, which may not be
authorized by existing laws.
