Chap. 365.—An ACT to amend and re-enact the act approved March
3, 1880, entitled an act to re-enact and renew the charter of the Peters-
burg Gas Light Company.
Approved March 10, 1884.
1. Be it enacted by the general assembly of Virginia, That
the act entitled an act to re-cnact and renew the charter of
the Petersburg gas light company, approved March third,
eighteen hundred and “eighty, be and the same is hereby re-
vised, renewed and amended go as to read as follows:
§1. Beit enacted by the gcneral assembly of Virginia, That
Andrew Kevan, Alexander Donnan. David B. Tennant, James
Dunn, George H. Davis, John McGill, John G. Dunn, William
F. Spotswood, H. G. Leigh, B. F. Cosby, David Steel, and
such other persons as may now or hereafter be associated
with them, shall be and they are hereby incorporated and
made a body politic and corporate under the name and style
of the Petersburg Gas Light Company, with full power to
construct or purchase suitable works and machinery, either
in the city of Petersburg or the counties of Prince George,
Chesterfield or Dinwiddie, or any or allof said places, for the
manufacturing, distribution and sale of gas, clectricity, or
other material from bituminous or other substances, for the
purposes of public and private heating and illumination, and
for power both within the corporate limits of the city of
Petersburg and without the same, in the counties of Prince
George, Chestertield) and Dinwiddie, adjacent to said city;
and for the purpose of carrying into full effect the works
herein provided for, the said company shall have power to
purchase and hold such real estate, not exceeding twenty
acres, located cither in the city or countics atoresaid, or in all
or any of said: places, as may be necessary for their works
and the proper carrying on of their business; and they are
hereby invested with all the powers confer red, and subjected
to all the provisions prescribed by chapters titty-six and fifty-
seven of the Code of Virginia, edition of eighteen hundred
and seventy-three, except in so fir as may be otherwise pro-
vided in this act.
§2. Be it further enacted, That the capital stock of the
Petersburg gas light company shall not be less than twenty
thousand dollars, nor more than five hundred thousand dollars,
to be divided into shares of twenty-five dollars each, to be
raised by subscription; for which purpose, if the stock be not
otherwise subscribed, books may be opened under the super-
intendence of John G. Dunn, William F. Spotswood, George
H. Davis, H. G. Leigh, B. F. Cosby, Alexander Donnan, and
John Medill, and such other persons as may be associated
with them, or any two of them, in conformity with the law
in such cause made and provided. And the stock of said
company shall be deemed and considered personal estate.
~§3. Be it further enacted. That the said company shall be
authorized, with the consent of the common council of said
city, to open the streets, avenues, highways and public parks
and squares of the said) city and counties, for laying pipes,
planting polls or placing and working such apparatus as shall
be necessary to carry on the business of the said company :
provided that when the same shall be opened for that pur-
pose, they shall, as soon as practicable, be repaired by the
said company at its own cost and expense, subject to the
approval of the inspector or engineer of said city or the
council thereof.
§4. And be it further enacted, That it shall be lawful for
the common council of the city of Petersburg to cause any of
the streets, avenues, lanes, parks, alleys, or other highways
in the said city, to be lighted at the expense of the said city,
if they deem it expedient.
$5. All parts of said act herein first above recited, and
which is hereby revised, renewed and amended, save and
except such as are contained in this act, are hereby repealed.
2. This act shall be in force fromand after its passage, and
shall continue in force forthe period of thirty years from the
date of its passage, subject, however, to amendment or repeal
at the pleasure of the weneral assembly.
