Chap. 338.—An ACT to provide for working and keeping in repair the
public roads in Albernarle county.
Approved March 7, 1884.
1. Be it enacted by the general assembly of Virginia, That
the judge of the county court of Albemarle muy, by and with
the consent of a majority of the board of supervisors of
Albemarle county, ascertained by a recorded vote, appoint one
or more commissioners to receive proposals for building or
repairing any bridge, or making, altering, or keeping in order
the whole or any part of any or all the roads in said county;
such keeping in order to be for such time as the court may
prescribe: provided that when the gross expenditure with
which the county will be chargeable, will in any case exceed
thirty dollars, before ordering the work the court shall make
an estimate thereof, and certify the same to the board of
supervisors of the county. Said board shall determine by a
recorded vote, whether the proposed expenditure is expe-
dient, and if a majority of the members of the board shall
deem it expedient, the expenditure shall be made; otherwise
it shall not be made.
2. The county court judge may, by and with the advice
and consent of a majority of the board of supervisors, ascer-
tained by a recorded vote, employ as many special surveyors
as may be deemed necessary, who shall, under the super-
vision of a commissioner appointed by the judge of the county
court, and by direction of the judge of the county court, buy
material and tools, hire labor and superintend any work
ordered in pursuance of the provisions of the first section of
this act. The said special surveyors shall qualify before the
judge of the county court, cither in term time or in vacation,
y taking the usual oath of office. The said gpecial survey-
ors shall prepare and have realy their pay-rolls when called
for by the commissioner and pay-master hereinafter provided
for.
3. The judge of the county court may, and with consent
of the majority of the board of supervisors, appoint a com-
missioner, who shall examine and report to the judge of the
county court, upon the work done under the direction of said
special surveyors; shall receive the pay-rolls from said special
surveyors, pass upon the same, and under the direction of the
judge of the county court, shall pay such claims as are found
to be properly embraced in said pay-rolls. Any commis-
sioner appointed under this section, shall qualify before the
judge of the county court, by taking the usual oath of office,
and giving bond to be approved by aid judge of the county
court. Such qualification may be either in term time or
vacation.
4. The board of supervisors shall prescribe the compensa-
tion of all special surveyors and commissioners appointed
under this act.
5. The judge of the county court, by and with the advice
and consent of the board of supervisors, shall provide for
keeping the county roads in order, when once they have
been put in good order, by contract or otherwise, as may be
deemed most advisable, and shall prescribe rules and regula-
tions for carrying into effect, the county road system hereby
enacted; and said judge of the county court may assign to
any contractor for keeping In repair, any section of county
road, the labor of the neighborhood, as provided by the gene-
ral road law of the state: provided that no citizen shall be
ealled upon for more than three days in the year.
6. This law shall be in force from date of passage.
