Chap. 337.—An ACT to authorize a subscription by the county of
Frederick, in money or bonds, to the stock or bonds of the Washing-
ton, Ohio and Western Railroad Company.
Approved March 7, 1884.
1. Beit enacted by the general assembly of Virginia, That
it shall be lawful for the board of supervisors ot Frederick
county to make a subscription to tho stock or first mortgage
bonds of the Washington, Ohio and Western railroad com-
pany in the following manner:
2. The board of supervisors of the county of Frederick
may at such time, in such manner, and upon such conditions
as to it shall scem proper, submit to the qualified voters of
the said county, exclusive of the voters of the city of Win-
chester, the question of a subscription by the county of
Frederick, in money or bonds, to the stock or first mortgage
bonds of the Washington, Ohio and Western railroad com-
pany, or of transferring to said company any subscription to
any other railroad company heretofore made by the county
of Frederick, the terms and conditions of whieh have not
yet been complied with, and these questions may be sub-
mitted either together or separately. Before such submission
is made, the amount to be subscribed, whether it shall be for
stock or bonds, the conditions of said subscription, and the
amount of subscription to be transferred, shall be duly pub-
lished in some newspaper or newspapers published in the city
of Winchester or county of Frederick; but the amount of
such subscription, including the amount to be transferred,
shall not exceed the sum ot one hundred and fifty thousand
dollars: provided that nosuch submission shall be made until
it shall have been approved by the county court of Frederick
county, and an order to that effect entered on the order-book
of said court.
3. The submission shall be by ballot to the qualified voters
of Frederick county, exclusive of the voters of the city of
Winchester, and may be at a regular or special election, as
the board of supervisors, with the consent of the county
court, may determine. The result of the election shall be
certified to the ¢ county court of Frederick county, and if it
appear that at least three-titths of the votes cast are for the
subscription oretransfer, or both, as the submission published
under authority of this act may indicate, it shall be the duty
of the board of supervisors to carry out and perfect the same,
and authority is hereby given to it to cause to be issued such
bonds of the county of Frederick as may be necessary for
that purpose.
4. All acts and parts of acts in conflict with this act are
hercby repealed.
