Chap. 335.—An ACT for the relief of the sureties of L. L. Deakins,
treasurer of Greenesville county.
Approved March 7, 1884.
Whereas it appears that five several judgments have been
entered by the circuit court of the city of Richmond, in favor
of the commonwealth against L. L. Deakins, treasurer of
Greenesville county, and William B. Rowzie, B. F. Jarratt, J.
J. Moore, and W. H. Walton, his sureties in his official bond
for the years eighteen hundred and seventy-seven, seventy-
eight, and seventy-nine, for taxes unaccounted for by the said
treasurer, and it being represented to the general assembly,
that in making up the accounts of the said Deakins, the
auditor of public accounts has failed to credit him with the
amount of the delinquent taxes allowed by the county court
of Greenesville, in accordance with law, during the period
aforesaid; therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts is hereby authorized and em-
powered to credit the said judgments against the said Dea-
kins, treasurer, and his sureties, with the amount of delin-
quent taxes allowed by the county court of Greenesville, ac-
cording to law during the period atoresaid, and any other
sum or sums of money properly paid by the said treasurer,
during the said period, for and on account of the common-
wealth, which have not already been allowed in the account
of the said auditor of public accounts, with the said Deakins,
treasurer.
2. That the auditor of public accounts is hereby autho-
rized and directed to accept trom William B. Rowzie, B. F.
Jarratt, J. J. Moore, and W. H. Walton, sureties of L. L.
Deakins, treasurer of Greenesville county, or either of them,
in full satisfaction of their indebtedness to the state as sure-
ties of the suid Deakins, treasurer, for the period above re-
ferred to, the bonds of the state of Virginia, with all unpaid
coupons attached, issued under the act of February four-
teenth, eighteen hundred and eishty-two, to the amount of
the balance due for the several years above referred to, with
interest at the rate of six per centum per annum, upon the
several amounts from the times they were respectively due,
as ascertained by the judgments of the commonwealth,
against them above referred to, within eighteen months after
the passage of this act: provided that nothing herein con-
tained shall be construed as releasing said L. L. Deakins,
from his liability for the difference between the amount now
due by him, and the market value of the bonds hereby
directed to be received.
