Chap. 326.—An ACT for the relief of R. J. Montgomery.
Approved March 7, 1884.
Whereas at the December term, cighteen hundred and
seventy-nine, of the county court of Mecklenburg, a fine of
three hundred dollars was imposed on Lewis W. Wimbish,
late treasurer of said county, for six weeks’ failure to lay his
bond as such treasurer before the commissioner of accounts
for examination, as required by law; and whereas upon
appeal, said judgment was aftirmed, and the said fine
of three hundred dollars bas been paid into the treasury
of this state by R. J. Montgomery, the security of said
Lewis W. Wimbish, on his appeal bond as aforesaid; and
Whereas it manifestly appears from the certificate of facts
and opinion of the circuit judge of Mecklenburg, upon pro-
ceedings had in accordance with the act of assembly ap-
proved March ninth, eighteen hundred and eighty, that the
failure of said Wimbish to submit his bond for examination,
was owing to the fact of the act of assembly not having been
received in Mecklenburg; and that it was at most only a
technical violation of the law, causing no loss or damage to
the state or to any person; therefore,
1. Be it enacted by the general assombly of Virginia, That
the auditor of public accounts be and he is hereby authorized
and required to issue his warrant on the treasury, payable
out of any money therein not otherwise appropriated, in
favor of R. J. Montgomery, for three hundred dollars, being
the amount paid by him as security for L. W. Wimbish, late
treasurer as aforesaid.
2. This act shall be in force from its passage.
