Chap. 284.—An ACT to incorporate the town of Goshen, in the county
of Rockbridge.
Approved March 4, 1884.
1. Beit enacted by the general assembly of Virginia, That
the town of Goshen, in ‘the county of Rockbridge, as the
same has been or may be laid off into lots, streets and alleys,
shall be and the same is hereby made a town corporate by the
name of Goshen, and by that name shall have and exercise
all the powers, rights, privileges and immunities, and be sub-
ject to all the provisions of chapter fifty-four of the Code of
Virginia of eighteen hundred and seventy-three, so far as the
same relates to towns of less than five thousand inhabitants,
and are not in conflict with the powers herein conferred.
2. That the boundaries of said town shall be as follows,
namely: Beginning at H. O. Goodloe’s and Mrs. E. A. MeCor-
mick’s corner, at Big Calf Pasture river; following Goodloe’s
and McCormick's line south to Victoria railroad; and thence
on Goodloe’s and McCormick’s line west to their corner south
of the Chesapeake and Ohio railroad; thence with their line
to the Chesapeake and Ohio railroad, crossing railroad to
McCormick’s and Michiel’s corner, and with their line to Mill
creek; thence up Mill creck to Roadcup’ 8 mill-race; thence a
northeast line to Big Calf Pasture river; thence ‘down the
river to the beginning.
3. The government of svid town shall be vested in a mayor
and a council of five, who shall be residents of said town, and
shall be elected on the fourth Thursday in May by those
qualified to vote for members of the general assembly, and
who shall have resided within the boundaries of the corpo-
ration for three months next preceding the election. The
said mayor and council shall bold their offices for four years,
and until their successors are elected and qualified: provided
that the officers first elected under this act shall be elected
and qualify within sixty days after its passayve, and shall
hold their offices until the first day of July, eighteen hundred
and eighty-seven.
4. The said council shall have power to pass all by-laws
and ordinances necessary for the proper government of said
town, not in conflict with the constitution and laws of the
state of Virginia and the constitution and laws of the United
States; and also to provide for the keeping of the streets of
said town in order, and for all other necessary improvements.
5. The council shall annually appoint a sergeant and trea-
surer, and shall fix their compensation and prescribe their
duties, and require such bond as may be deemed proper.
6. The mayor shall preside at all meetings of the council
when present, and when they are equally divided shall give
the casting vote; and he shall be invested with all the powers
of a justice of the peace within the limits of said town. In
the absence of the mayor the council may elect a president
of the meeting.
7. The sergeant shall be vested with all the powers of a
constable witbin the limits of said town. He shall collect all
town levies, and have power to distrain and sell therefor in
like manner as a county treasurer may distrain and sell for
state taxes.
8. The sergeant of said town shall be a conservator of the
peace, and shall have power to arrest in said town, or any-
where in Rockbridge county within two miles of said town,
upon a warrant issued by the mayor, any person charged
with violation of the laws or ordinances of said town; and
he shall have power, upon a like warrant, to arrest anywhere
in Rockbridge county, any person charged with the commis-
sion of any crime in said town, or within one mile of its
corporate limits. When a violation of the laws or ordinances
of said town is committed in his presence, he shall have
authority and power forthwith to arrest the offender and
carry him before some conservator of the peace of said town,
to be dealt with according to law.
9. The said council shall have power to impose a license-
tax not exceeding five dollars on all persons on whom the
state has imposed a license-tax: provided however, that they
may impose a further tax of not less than twenty dollars
or more than two hundred and fifty dollars, on all liquor
dealers and on all handlers of liquor as a beverage, and
keepers of bowling alleys, billiard and bagatelle tables.
10. The council may, annually, levy a tax for all purposes,
by a two-thirds vote, which on no property shall exceed
twenty cents on the hundred dollars’ valuation, except that
on a petition of freeholders representing two-thirds of the
valuation within the town, the council may levy a corpora-
tion tax not to exceed forty cents on the assessed valuation
of property in said town: be it provided however, that no
tax be imposed on the stock used in carrying on any business
for which a special license tax is assessed.
11. No license shall be granted to any person, club, or
corporation, to sell wine, ardent spirits, malt liquors, or any
mixture thereof, alcoholic bitters, or fruits preserved in ardent
spirits, either by wholesale, retail, or to be drunk at the place
where sold, or in any other way, within the corporation hmits
of said town, or within one mile thereof, without, unless, and
until the applicant sball have produced to the court or officer
authorized to grant such license, the written consent of the
council of said town.
12. The mayor and sergeant of said town shall have power
and authority to deputize any number of citizens of the town,
and citizens of said county who may be in said town, to assist
the sergeant in the full discharge of his duties, in all cases
of riots and misdemeanors.
13. This act shall be in force from its passage.
