Chap. 282.—An ACT to amend and re-enact an act entitled an act to
incorporate the Nansemond and Isleof Wight Drawbridge Company.
Approved March 4, 1884.
1. Be it enacted by the general assembly of Virginia, That
it shall be lawful to open books for receiving subscriptions to
an amount not exceeding thirty thousand dollars, in shares
of fifty dollars each, for constructing a toll-bridge, with a
suitable draw across the Nansemond river, at or between
Cartwrights or Sleepy Hole wharf and Pig Point on the
east side, and the lands of J. J. Phillips and C. W. Grandy
on the west side of said river, in Nansemond county, and for
the purpose of constructing roads to connect either end of
said bridge, with the county roads in said county, and also
to construct wharves or piers on either side of said river, at
or adjoining the said bridge, on either side of the draw of
the same: provided the said bridge, wharves, or piers shall
not obstruct the navigation of said river. The said books
shall be opened in the towns of Suffolk and Smithfield, and in
the city of Portsmouth, or at either of said places, under the
superintendence of any three of the following named com-
missioners: J. W. Ames, George S. Rives, C. H. Causey, H.
Woodward, W. J. Lee, of Nansemond county; W.S. Grimes,
R. S. Thomas, J. W. Duck, T. Q. Gilliam, Charles Bunkly,
of Isle of Wight county ; John T. Griffin, R. T. K. Bain, John
S. Wise, M. P. Rue and William MacWhorter, of Norfolk
county; and Leigh R. Watts, of the city of Portsmouth.
2. When four thousand dollars of the capital stock of said
company shall have been subscribed, the subscribers, their
personal representatives or assigns, shall be, and are hereby
created and incorporated into a company, by the name and
style of the Nansemond and Ise of Wight drawbridge com-
any.
3) The said company shall be incorporated upon condition
that the draw of the bridge to be constructed across said
river, shall not be less than fifty feet in width in the clear,
and that said bridge shall be subject to the provisions of
chapters fifty-seven and sixty-one of the Code of Virginia,
eighteen hundred and seventy-three, so far as the same shall
be applicabe.
4, It shall be lawful for the Western Branch drawbridge
company, a corporation duly incorporated under the laws of
Virginia, to acquire by subscription, purchase or otherwise,
any portion of the capital stock of this company.
5. For the purpose of constructing said bridge and roads,
wharves or piers, the said company may purchase and hold
the land on which the bridge and roads, wharves or piers shall
be located, or the right of way over the same, as far as may
be necessary ; and if the president and directors of said com-
pany cannot agree for the purchase with the respective
owners of said land, or the right of way over the same, they
may proceed to have the same condemned for the purpose
aforesaid, in the manner prescribed for internal improve-
ment companies, by the fifty-sixth chapter of the Code. The
bridge shall be commenced within two years, and completed
within three years after the passage of this act.
6. As soon as said bridge is completed, the president and
directors of the said company may demand and receive such
reasonable tolls as their by-laws may prescribe; said tolls are
not, however, to exceed those allowed to be charged by the
general law, and shall be regulated in all respects in the
manner prescribed by such general law in reference to such
tolls.
7. As soon as said wharves and piers shall be completed,
the president and directors of said company may demand and
receive such reasonable rates of wharfage for the use and
occupation of the same, as their by-laws may prescribe.
8. This act shall be in force from its passage.
