Chap. 230.—An ACT regulating the working of public roads in the
county of Tazewell.
Approved March 3, 1884.
1. Be it enacted by the general assembly of Virginia, That
from and after July first, eiyhteen hundred and eighty-four,
the board of supervisors of Tazewell county shall tale charge
of and have worked and kept in repair all public roads and
bridges in said county, heretofore or hereafter established.
And for the purposes of this act, the said board is hereby
authorized and empowered to levy a road tax, not exceedin
ten cents on the one hundred dollars, on all the paracinl
property and real estate in said county liable to taxation,
and to adopt such regulations not in contravention of the
laws and constitution of this state, as may be necessary or
proper to secure the proper and efficient working of the roads
in said county.
2, The supervisor of each mayisterial district shall, in the
month of August, cighteen hundred and eighty-four, and
annually thereafter, after giving at least twenty days’ notice
of the time and place fixed by him for making such contracts,
by posting in three public places in the district, let to con-
tract to the lowest bidders, the work of keeping in good
order and repair the public roads and bridges, of not excced-
ing fifteen feet span, in each road district or precinct as now
laid out in the magisterial district of said county, or as the
county court of said county may hereafter re-arrange and
lay out the road districts or precincts of said county. Such
contracts shall be in writing, signed by the contractor and
the supervisor, and shall be fora period of one year, and shall
be subject to revision by the board of supervisors, and returned
to said board for its ratification or rejection at the first meet-
ing of said board after the same has been made. Each con-
tractor shall give bond with good security, in a penalty at
least double the amount of the contract bid, conditioned for
the faithful performance of the said contract, which bond
and contract shall be filed with the clerk of the board of
supervisors. And a recovery may be had for any breach of
the condition of said bond in the name of the county, for the
benefit of the road fund of said county, in the county court,
after ten days’ notice to the contractor and his securities;
which motion shall be prosecuted by the attorney for the
commonwealth of said county, who shall be entitled to a fee
of five dollars in each case where there is a judgment in favor
of said county, to be taxed in the costs against the defendant.
3. The failure of any contractor for fifteen days, to keep
any road embraced by bis contract, in proper order, shall be
a misdemeanor, and punishable by a fine of not less than five
dollars, not more than fifty dollars.
4. All able-bodied citizens of each road district, not exempt
under the general road law of this state, shall be required to
do three days work in each year, to help keep in repair, the
roads and bridges in such road district, which labor shall be
taken into consideration in making the contracts aforesaid.
And each contractor shall have all the rights and remedies
for requiring all persons not exempt as aforesaid, to labor on
the roads in the road district in which they reside, three days
in each year, and to enforce and collect the fines for failing
to work on the roads when summoned to do so; which is
conferred on the surveyors of roads by said general road law,
and shall not be liable for cost in any proceedings before a
justice for the recovery of the same, unless such fine is de.
cided by the justice not to be due.
5. The supervisor of each magisterial district, shall re-
ceive compensation for his service under this act, for the
time he is actually envaged, at the rate of two dollars per
day.
6. All levies made under this act, shall be collected by the
county treasurer in the same manner, and for the same com-
pensation that other county levies are collected, and shall be
payable to the contractors or their assignees, upon the war-
rant of the board of supervisors. No supervisor shall be in
any way interested in any contract for working, opening or
changing the public roads in said county, and any violation
of this provision, shall be a misdemeanor, and punishable as
such.
7. The opening of all new or changed roads, and the erec-
tion and repairs of all bridges exceeding fifteen spans, should
be done by contract, made with the supervisors in the same
manner and under the xame regulations that contracts for
working tho roads in said county are made, except that the
contract shall, after having been approved by the board of
supervisors , be certitied to “the county court for its approval,
and shall not be binding on the couuty until approved by
said court.
8. All acts and parts of acts inconsistent with this act are
hereby repealed, so tar as applicable to the said county of
Tazewell.
9. The general road law remains in full force for county
of Tazewell, unless specially repealed by this act
