Chap. 211.—An ACT to authorize a subscription by the city of Win-
chester in money or bonds to the stock or bonds of the Washington,
Ohio and Western Railroad Company.
Approved March 1, 1884.
1. Beit enacted by the general assembly of Virginia, That
it shall be lawful for the common council of the city of Win-
chester to make a subscription to the stock or first mortgage
bonds of the Washington, Ohio and Western railroad com-
pany in the following manner :
2. The common council of the city of Winchester may, at
such time, in such manner, and upon such conditions as it
shall seem proper, submit to the qualified voters of the said
city, the question of a subscription by the city of Winchester
in money or bonds to the stock or first mortgage bonds of
the Washington, Ohio and Western railroad company, or of
transferring to said company any subscription to any other
railroad company heretofore made by the city of Winchester,
the terms and conditions of which have not yet been com-
plied with, and these questions may be submitted either
together or separately. Before such submission is made, the
amount to be subscribed, whether it shall be for stock or
bonds, the conditions of said subscription, and the amount of
subscription to be transferred, shall be duly published in some
newspaper or newspapers published in the city of Winchester,
but the amount of such subscription, including the amount
to be transferred, shall not exceed the sum of one hundred
and fifty thousand dollars: provided that no such submission
shall be made until it shall have been approved by the cor-
poration court of the city of Winchester, and an order to
that effect entered on the order-book of said court.
3. The submission shall be by ballot to the qualified voters
of the city of Winchester, and may be at a regular or special
election as the common council, with the consent of the cor-
oration court, may determine. The result of the election
shall be certified to the corporation court of Winchester, and
if it appears that at least three-fifths of the votes cast are for
the sabscriptiqin or transfer, or both, as the submission pub-
lished under authority ot this act may indicate, it shall be
the duty of the common council to carry out and perfect the
same; and authority is hereby given to it, to cause to be
issued such bonds of the city of Winchester, as may be neces-
sary for that purpose.
4. All acts and parts of acts in conflict with this act, are
hereby repealed.
9. This act shall be in force from its passage.
