Chap. 185.—An ACT to transfer to the county of Frederick the State’s
interest in so much of the Northwestern Turnpike Company as lies
within the county of Frederick.

Whereas, under authority of an act passed by the general
assembly of Virginia, on the nineteenth day of March eigh-
teen hundred and thirty-one, entitled an act to provide tor
the construction of a turnpike road from Winchester to some
point on the Ohio river, a turnpike road was constructed by
the state of Virginia from Winchester to the Obio river; and
whereas, now by reason of the partition of the commonwealth
of Virginia only about seventeen miles of said road remain
within the present limits of Virginia, and this section lies
altogether in the county of Frederick ; and whereas it now
appears to this general assembly that the management and
control of such section of the road should be transferred to
the board of supervisors of Frederick county, to the relief of
the board of public works of Virginia.
1. Beit enacted by the general assembly of Virginia, That
the board of public works be and they are hereby “authorized
and directed to transfer all the right, title and interest of this
state in and to the Northwestern turnpike road, or s0 much
thereof as lies within the county of Frederick, together with
all bridges and other property belonging or appertaining
thereto, to the county of Frederick.
2. It shall be the duty of the board of supervisors of Fred-
erick county to take charge of so much of said road as lies
within said county, and cause the same to be put and kept in
repair. It shall forthwith appoint such officers and avents
as may be needed for the efficient operation of said road, and
may remove the same from time to time, as to said hoard
may seem proper. It shall cause the tolls to be faithfully
collected within the rates prescribed by law, and regularly
applied by the maintenance and improvement of the road,
and if there be any surplus revenue it shall be paid into the
treasury of the state. It shall have the same powers and
rights, with regard to said road, as heretofore may have been
held and exercised by the board of public works.
3. This act shall be in torce from its passage, but is subject
to revocation by act of the legislature.
