Chap. 130.—An ACT to incorporate the town of South Boston, in
Halifax county, Virginia.
Approved February 19, 1884.
1. Be it enacted by the general assembly of Virginia, That
the town of South Boston, in the county of Halifax, as the
same has heretofore or may hereafter be laid off into lots,
streets and alleys, shall be and the same is hereby made a
town corporate by the name of South Boston, and by that
name shall have and exercise the powers conferred upon
towns by the fifty-fourth chapter of the Code of Virginia of
eighteen hundred and seventy-three, and be subject to all the
provisions of said Code, and to all laws now in force, or which
may hereafter be enacted, in reference to the government of
towns of less than five thousand inhabitants, so far as the
kame are not inconsistent with the provisions of this act.
But no citizen of said corporation shall be required to work
on the public roads, nor required to pay school taxes, save
such as is levied by the state, or by the common council of
said town.
2. The boundaries of said town shall be as follows: Bein-
ning at a stone on the south side of the Richmond and Dan-
ville railroad, near the dry bridge; thence north thirty-cight
and one-quarter west, passing under the railroad at the dry
bridge, three hundred and forty-nine feet; north one, cast
forty: -two feet, north sixty, east five hundred and fitty-tive
feet, to a stake on north side of road, nearly in front of Hud-
son’s factory; thence north twenty-two and one-quarter east,
through the old ice pond, nine hundred and thirty-six feet, to
the corner of Jackson’s lot on second street; thence along
second street north, eight degrees fifty minutes west, one
hundred and thirty-four feet, to Bruce street; thence along
Bruce street south, forty-three and three-quarters west, sev-
enty-five feet; thence across Bruce, Clark, Coleman and Logan
streets north, forty-one degrees west, twelve hundred and
fitty-tive feet to the back line of the lots between Logan and
Leizh streets; thence with the back line of lots north forty-
eivht and one-quarter west, twelve hundred and fifty-five feet
to Jefferson street; thence along Jefferson street north no
devrees thirty-five minutes west, eight hundred and _ fifteen
feet to Third street; thence with Third street north eighty-
nine devrees twenty-five minutes east, five hundred an‘ ninety-
four feet to Washington street; thence along Washington
street north, no degrees thirty-five minutes west, seventeen
hundred and three feet to a stake and stone on the west side
of said street; thence across Washington and Main streets,
and along the new road north sev enty-eight and one-quarter
derrees east six hundred and thirty-nine feet to a stake on
the south side of road; thence with the back line of lots south
five and one-half deurees east, crossing Moore and Hodges
streets two thousand and sixty-four feet to the corner-stone of
William J. Jordan’s lot; thence south one and one-half degrees
‘ast, five hundred and thirty-two feet to the old Trish road ;
thence down the road south seventy-tour and one-half degrees
east. two hundred and eighty-two feet to Hodges’ old ‘line;
thence Hodges’ old line south eight degrees forty minutes
vast, to the south side of the Richmond and Danville railroad
track on said line; thence along south side of railroad track
to the hevinning.
3. The jurisdiction of the corporate authorities of said
town. shall extend one mile outside of the limits thereof, and
for imposing and collecting a license tax on all shows, pertor-
mances, and exhibitions, which shall take place anywhere
within said extended boundary.
4. There shall be elected biennially, on the first Tuesday
in December, seven trustees of said town, who shall be quali-
fed voters of the town. The person so elected, shall enter
upon the duties of their office, the first day of January next
succeeding the election, and shall hold their offices for two
years, and until their successors are clected and qualified.
They shall compose the council of the town, and shall elect
one of their number to be mayor of said town. They may
fill any vacancy arising in their own body for the unexpired
time. The mayor shall appoint three qualified voters of said
town, one of whom shall act as clerk, to hold said election
hetween the hours of one in the afternoon and sunset, and
they shall decide any contest with reference to right to vote,
of any individual, and shall count the ballots. In case it is
impossible to determine the seven who have the highest
number of votes, by reason of a tie, the said clerk shall deter-
mine the matter, in the presence of his associates, by lot.
The persons holding the election, shall determine who have
received the greatest. number of votes in such election, and
shall certity the same. and an abstract of the votes on the
poll-books, and return the same, together with the ballots, to
the clerk of the council, to be by him preserved, and said
clerk shall immediately ‘therealter, mite out and deliver to
each of the persons elected, a certificate of election.
5. The council shall elect annually a Berecant, treas-
urer, assessor, and such other officers as shall be needful for
the town vovernment, and fix their duties and compensation,
so far as consistent with the general laws of the state, and
one person may fill more than one office; to remove any
such officers, and to require of any officer a bond, with
approved security, for the faithful performance of the duties
of the office. The council shall also appoint, as soon as it
may be deemed expedient, an assessor of all lands and lots,
together with the improvements thereon, and shall require
of him a bond, with approved security, for the faithful per-
formance of his duties.
6. The mayor shall bave the jurisdiction and authority of
a justice of the peace of Halithx county within the corporate
limits of said town and within one mile of the limits of said
corporation, and shall be entitled to the same fees.
7. The sergeant of said town shall have the same powers
and authority. within the limits of said town, and for one
mile beyond the same, in all matters arising within said town,
as a constable or collector of the county of Halifax, receive
the same fees, and be subject to the same penalties prescribed
by law as to constables. And in addition he shall have the
same power and authority as special police appointed by
judge of the county court, by section fifteen, chapter one
hundred and ninety-six, Code of Virginia, eighteen hundred
and seventy-three.
8. The council shall have the power to pass all by-laws
and ordinances tor the government of said town that they
may deem proper, not in conflict with the constitution and
laws of the state; and also provide for keeping the streets in
order, and paving the same, and tor other necessary IMmprove-
ments, for which purpose ‘they may levy such tax as they
may deem proper on all property in the said town, and on all
vocations, professions or business, as is now subject to taxa-
tion by the revenue laws of this commonwealth, and on dogs
belonging to persons residing in said town: provided the
‘ate of tax on real and personal property shall not exceed
fifty cents on the one hundred dollars of property for muni-
cipal purposes. The council shall not expend any more in
one year than the receipts of that year.
9. The council shall have power to mark accurately the
bounds of existing streets, alleys and sidewalks, to lay otf
and open new streets, alleys and sidewalks, and private pro-
perty for public use may be taken in the manner now pro-
vided by law, and for that purpose the mayor's court of said
town shall have the same Jurisdiction for the condemning of
lands for the streets of said town as the county court has for
condemning lands for roads in the county.
10. The council shall cause to be made a map of the town,
defining all the boundaries, streets, alleys, squares and _ lots,
numbering the lots, and giving the quantity in each.
11. That any persons : applying to the county court of Hal-
ifux county tor license to sell spirituous liquors, wine, beer,
ale or porter, or any mixture thereof, within the corporate
limits of the town of South Boston, or within one mile of the
limits of said corporation, shall produce before the court of
the said county a certificate of the council of said town to
the effect that the applicant is a suitable person, and that no
good reason is known to said council why said license should
not be granted. And the court of said county shall not grant
any license to sell liquors within the limits above prescribed
until and unless such certificate be given.
12. The corporate limits of the town of South Boston,
shall constitute a school district, and the council shall ap-
puint, as soon as it may deem expedient, three trustees for
the public schools, to serve one, two and three years. respec-.
tively, and annually thereafter, it shall appoint a school trus-
tee to serve three years.
13. For the purposes of carrying into effect the police regu-
lutions of said town, the said town shall be allowed, unless
they make provision otherwise, the use of the Jail of Halitax
county, for the safe keeping and confinement of all persons
who shall be sentenced to imprisonment under the ordinances
of said town.
14. From and after this act goes into effect and until the
councilmen to be elected under its provisions, shall have
been elected and qualified, W. W. Ward, Robert E. Jordan,
James Traver, W. H. Shepherd, J. M. Carrington, Samuel E.
Webster, and Joseph Stebbins, are hereby appointed and de-
clared councilmen, and may qualify before any justice of the
peace of Halifhx county, and thereupon they shall constitute
the council of the said town of South Boston, and may orga-
nize and perform the duties of said council.
