Chap. 114.—An ACT to amend section 538, chapter 167, of the Code of
1873, relative to Decrees in Chancery Causes.

1. Be it enacted by the general assembly of Virginia, That
section fifty-three of chapter one hundred and sixty seven, of
the Code of eighteen hundred and seventy-three, be amended
and re-enacted as follows:
§53. Any judge of the circuit court, as well in vacation as
in term, may at chambers make and direct all such inter-
locutory orders, rules and other proceedings, preparatory
to the hearing of all causes upon their merits, in the
same manner and with the same effect as if made in
term; reasonable notice of the application therefor being
first given to the adverse party or his attorney. All
orders of any kind so made in vacation shall be entered by
the clerk as if made in term. By consent of parties given in
open court or before the said Judye and entered of record,
chancery causes may be submitted to the judge of the court,
in vacation, wherein such cause is pending tor decision or
decree, to be made therein in vacation, and all decrees so
made and entered by the clerk in vac: ition shall be deemed as
valid as though they had been made in open court.
2. This act shall be in force from its passage.
