Chap. 112.—An ACT to amend and re-enact section 23 of an act en-
titled an act for the Preservation of Oysters and to obtain revenue
for the privilege of taken them within the waters of the Common-
wealth, approved April 18, 1874.

1. Be it enacted by the general assembly of Virginia, That
section twenty-three, chapter two hundred and fourteen of
Acts cighteen hundred and seventy-four, be amended and
re-enacted so as to read as follows:
§ 23. Hereafter it shall not be lawful for any person to take
or catch oysters in the waters of this commonwealth, from
the fitteenth day of May, to the first day of September. But
this prohibition shall not prevent persons who have planted
oysters from taking them from their private plantings at any
time for family use. Any person offending against the pro-
visions of this section, shall forfit and pay for each offence,
not less than ten nor more than fifty dollars.
2. <All acts or parts of acts inconsistent with this act, are
hereby repealed. :
3. This act shall be in force from its passave.
