Chap. 90.—An ACT directing the governor to convey to the United
States the title of the commonwealth to certain real estate in West-
moreland county, and ceding jurisdiction over the same to the United
States, and exempting the same from taxation.
Approved April 21, 1882.
Whereas Lewis W. Washington did, by deed bearing date
the first day of September, in the year of our Lord one thou-
sand eight hundred and fifty-eight, and recorded in the clerk’s
office of the county court of Westmoreland county, convey
to the commonwealth of Virginia sixty feet square of ground
on which the house stood, in which Panera George Wash-
ington was born, the same situate, lying and being in the
said county of Westmoreland; and whereas one John E.
Wilson did, by deed bearing date the first day of August, in
the year of our Lord one fhousand eight hundred and fifty-
nine, and recorded in the clerk’s office of the county court of
Westmoreland county, convey unto the commonwealth of
Virginia one acre of land, or so much less as might be re-
quired, annexed to the said ground of sixty feet square, by
the said Lewis W. Washington, as to contain equal quantities
on either side of the said sixty feet square of ground, and
did also, by some deed, convey to the commonwealth a cer-
tain quantity of land for a public road or highway leadin
from the said birthplace across the estate called Wakefield
in the said county of Westmoreland, and accurately described
in said deed; and whereas the congress of the United States,
OY joint resolution, approved on the twenty-sixth day of
ebruary, anno domini eighteen hundred and eighty-one, has
appropriated the sum of thirty thousand dollars for the pur-
pose of erecting a monument at, and to mark the birthplace
of George Washington: provided the secretary of state shall
be satisfied with the title to the land to be occupied by the
roposed monument, and a public right of way thereto can
be secured; and whereas the general assembly of Virginia is
desirous of promoting the object of the said joint resolution
of congress; therefore,
1. Be it enacted by the general assembly, That the gov-
ernor of the state is authorized and directed to convey all
right, title, and interest of the commonwealth of Virginia in
and to the above desired real estate to the United States.
But on condition solely, that there shall be erected on the
said site of the birthplace of George Washington, and withb-
out unnecessary delay, a monument as contemplated and
provided for by said joint resolution of congress.
2. Be it further enacted, That jurisdiction over the said real
estate, hereby directed to be conveyed, is ceded to the United
States, but subject to the following terms and conditions,
to-wit:
First. That this state retains concurrent jurisdiction with
the United States over said real estate, so that courts, mag-
istrates, and officers of this state may take such cognizance,
execute such process, and discharge such other legal functions
over and upon the same as may not be incompatible with the
conveyance of title thereto, herein directed.
Second. That if the purpose of said grant should cease, or
there should be a failure on the part of the United States to
use said real estate for said purpose, then the jurisdiction
hereby ceded over the same shall cease and determine, and
the same shall revert to the commonwealth of Virginia. The
said real estate and any property of the United States
thereon, for the purpose of this act and of the said joint reso-
lution of congress, is hereby exempted from all taxes imposed
by this state or by the constituted authorities of Westmore-
land county, or by any other authority subject to the laws of
this state. But this exemption shall continue only so long as
said real estate shall be used by the United States for the pur-
poses aforesaid.
3. This act shall be in force from its passage.
