Chap. 26.—An ACT to incorporate the Bristol and Ervinton Turnpike
Company.
Approved January 19, 1882.
1. Be it enacted by the general assembly of Virginia, That
W. W. James, D. F. Bailey, R. C. Craig, Henry Holly, John
M. Hamilton, and C. P. Crumley, of Washington county ;
Joseph C. Fugate, William E. Sutton, R. P. Vickers, William
J. Dickenson, C. C. J. Dickenson, and William Fields, of Rus-
sell county; Joseph Kelly, Jesse Wampler, James Smith,
James Colly, Jessee Lee, and John P. Chase, of Dickenson
county, and such other persons as may hereafter be associ-
ated with them, be and are hereby made a body politic
and corporate, under the name, style, and title of The Bristol
and Ervinton Turnpike Company, with plenary powers to
construct a turnpike road from the town of Goodson, in
Washington county, Virginia, along the most practical route
via Mendota, and through the Joe Tate gap, in Clinch moun-
tain; thence the most practical route via Bickley’s mills to
Clinch river, at or near Dickenson ford, in Russell county ;
thence the most practical route by Dorado and up the right
fork of Lick creek, and down McClure creek to Ervin-
ton, in the county of Dickenson; and to erect bridges at
the crossings of Holston and Clinch rivers, if found to be
necessary. Said company is also hereby vested with full
power and authority to acquire, by gift, purchase, or by
condemnation according to law, so much land, timber, and
rock as may be necessary for the construction of said road:
provided that said road shall not be less than sixteen fect, nor
more than thirty feet wide: and provided the said work shall
be commenced in one and be concluded in five years. .
2. Books of subscription to the capital stock of said com-
pany may be opened at any time and place designated by
said corporators, or any three of them, under the supervision
of themselves or any person or persons appointed by them,
who are hereby authorized to act as commissioners. The
capital stock of said company shall not be less than one thou-
sand dollars nor more than twenty thousand dollars, to be
divided into shares of ten dollars each.
3. The said company is hereby clothed with all powers and
franchises conferred on turnpike companies by the general
laws of the state: provided that said company may be at
liberty to dispense with a summer or side road to said turn-
pike; and that the company shall not be compelled to pave
or cover the said road with stone or gravel.
4. The corporators and stockholders of said company shall
meet at Bickley’s mills, in Russell county, on the first Mon-
day in May next, or as soon thereafter as practicable; at
which time and place they shall elect a president and board
of directors, and such other officers as they may deem neces-
sarv. and pass any by-laws, not in conflict with the constitu-
tion and laws of this state or of the United States, which
they may deem necessary for their government; a majority
of whom shall constitute a quorum. All elections after the
first held by said company, shall be at such time and place as
they may direct. All officers elected by said company shall
hold their offices for such length of time as may be agreed
upon by said company, and afterwards until their successors
are elected and qualified to enter upon the duties of their
respective offices. The term of all officers elected by said
company shall commence at such time as may be prescribed
y them.
5. Said company shall have the right to cross the beds of
euch public roads as may be necessary.
6. A majority of the directors of said company shall con-
stitute a quorum for the transaction of business.
7. This act shall be in force from its passage.
Chap. 26.—An ACT to incorporate the L. O. L. Order of Brotherhood.
Approved April 7, 1882.
Be it enacted by the general assembly of Virginia, That
J. E. Jackson, N. C. Mills, Joseph G. Rock, William Dardy,
Philip V. Shera, Phineas Cox, R. E. Jackson, Jacob Wilhelm,
Benjamin S. Adkins, W. T. Tinsly, Samuel Brockman, and
Martin Grose, their associates and successors, are hereby con-
stituted a body corporate, by the name of L. O. L. Order of
Brotherhood, for the following purposes and with the follow-
ing privileges:
Ist. To fraternally unite all persons acceptable to its organ-
ization, and who are over twenty-one years of age.
2d. To give all moral and material aid in its power to its
members and those dependent upon them; to gain by union
that strength and concert of action, without which their
proper and vital interest cannot be fostered or protected
successfully.
| 8d. The said corporation shall have the power to make and
adopt a constitution and by-laws, rules and regulations for
the admission and expulsion of its members and their govern-
ment; the number and election of its officers, and to define
their duties; and for the safe-keeping and protection of its
property and funds; and from time to time to alter or repeal
| such constitution, by-laws, rules and regulations: provided
the same be not inconsistent with the constitution and laws
of the United States or of the state of Virginia.
4th. The said corporation may form one or more lodges in
/ any county in this state, and may form one principal lodge
| in each county, and one principal lodge for the whole state.

5th. The said corporation may purchase and hold or lease
any real-or personal estate, provided that it shall not hold
any real estate exceeding all together one acre 1n any county.
6th. This act shall be in force from its passage, and be
subject to amendment, alteration or modification at the plea-
sure of the general assembly.
