Chap. 256.—An ACT to provide for working and keeping in order the
roads of the counties of Churles City and New Kent, and repeal sec-
tions 21 and 22 of chapter 181, «f an act entitled an act to provide
for working and kerping in order the roads of this commonwealth,
approved March 20, 1875, so far as they upply to said counties of
Charles City and New Kent.
Approved March 6, 1882.
1. Be it enacted by the general assembly, That sections
twenty-one and twenty-two of chapter one bundred and
eighty-one, entitled an act to provide for working and keep-
ing in order the roads of this commonwealth, approved
March twentieth, eighteen hundred and seventy-five, for the
counties of Charles City and New Kent, be repealed, and the
following be substituted in lieu thereof :
2. That it shall be the duty of the board of supervisors of
the said counties on the first Monday in June, after the pas-
sage of this act, and yearly thereatter, to appoint one super-
visor of the road for each road district as pow laid off, or
may hereafter be laid off, whose duty sball be to keep the
roads in his district in order. And for that purpose the said
supervisor of roads is authorized to hire labor and teams at
such time and place as he shall deem fit; and said road
supervisor shall be authorized to purchase such material and
tools as may be absolutely necessary to keep said roads in
order.
3. The said road supervisor shall keep a record of the
hands employed, the time and place, and the amount due for
teams and material, and to whom entitled to pay therefor, in
a book kept for that purpose; and sball report a certified
copy of the same to the judge of the county court at least
once in three months, and oftener if he thinks fit. After
such accounts have been approved by the judge, he shall
order the clerk of the court to issue to the parties entitled,
a transcript for the same, which shall be paid to the holder
thereof out of any moneys in the county treasury, or receiv-
able for county taxes.
4. The board of supervisors shall bave the right to require
bond and surety of the supervisors of the roads, if they
think proper, and shall fix the pay of said supervisors of
roads tor each day actually employed on the road, and shall
also fix the pay of laborers, and shall also fix the price of
teams employed on the roads. __
3. If any road supervisor shall allow any road in his dis-
trict to remain in bad order for a longer time than ten days.
except he can show good cause therefor, he shall be deemed
guilty of a misdemeanor, and fined not less than ten nor
more than fitty dollars, at the discretion of the court.
6. For the purpose of carrying out and paving the expenses
of this act, it shall be the duty of the board of supervisors,
at their regular meeting in July, after the passage of this
act. to levy a road tax on the real and personal property in
said counties in amount sufficient to pay the costs of the
same, not to exceed twenty-five cents on the one hundred
dollars for the first year, which shall be collected by the
treasurer of the county as other taxes are collected.
7. If the board of supervisors of the said counties shall
fail to carry out the provisions of this act, they: shall be
deemed guilty of a misdemeanor, and shall be fined each not
less than one hundred dollars nor more than five hundred
dollars, at the discretion of the court.
8. This act shall bein force from and after the first Mon-
day in June. eighteen hundred and eighty-two.
