Chap. 245.—An AOT authorizing and directing the directors of the
Central Lunatic Asylum to contract for the erection, near the city of
Petersburg, of suitable buildings for the accommodation of the col-
ored insane of the state.
Approved March 6, 1882.
Whereas it appears to the general assembly, That it is
necessary to provide a suitable location for the permanent
establishment of the Central lunatic asylum, for the reception
and treatment of colored persons of unsound mind, now tem-
porarily located at Howard’s grove, near the city of Rich-
mond; and whereas a commission elected by the general
assembly, for the purpose of electing a site for its permanent
location, did select as such site New Market or Hare’s farm,
a tract of land lying in the county of Prince George, adjacent
to the city of Petersburg, containing three hundred acres ;.
which said site, or tract of land, the city of Petersburg, by
a vote of its common council, has offered to donate to the
stato, free of charge, if the said asylum should be thereon
permanently located:
1. Beit enacted by the general assembly, That the directors
of the Central lunatic asylum be, and they are hereby
directed, as soon as there is made or declared to them a deed
conveying to them for the use of said asylum, the said tract
of land known as Hare's farm, and a plan for the buildings
shall have been agreed upon as herein provided, to contract
for the building thereon a commodious house or houses,
suitable and necessary for the proper reception and accom-
modation of persons of color of unsound mind, upon the
terms hereinafter set forth, having previously given public
notice, by advertisement, in some newspaper published in
the city of Richmond and the cities of Petersburg, Lynch-
burg, and Norfolk, that they will receive proposals for the
building thereof, according to the plan and specifications
adopted as hereinafter provided for, and shall take bonds
with sufficient security, from such person or persons contract-
ing for the construction of said buildings in the penal sum of
twenty thousand dollars, payable to themselves and their
successors in office, conditioned for the faithful performance of
said contract, under the immediate superintendence of said
directors.
2. It shall be the duty of the said directors of the Central
lunatic asylum, immediately after the passage of this act, to
procure, from competent architects, plans or designs for the
uildings to be erected upon the said tract of land, and from
the plans proposed, to select and adopt such one as may seem
to them most desirable and proper; according to which the
said building shall be erected. But this section shall not be
construcd as preventing the said directors from refusing any
or all plans suggested, or from adopting any plan heretofore
proposed for the said buildings. And for the purpose of car-
rying out the provisions of this section, the said directors are
hereby authorized to expend, out of any appropriation made
for the purpose of building the said houses, a sum not to
exceed two thousand dollars.
3. The contract for the erection of the buildings shall pro-
vide for the completion of the work in a good and workman-
like manner, according to the plan and specifications, on or
before the first day of January, eighteen hundred and eighty-
three, and for a forfeiture of the sum of five hundred dollars
for each month or part of a month, after the said first day of
January, eighteen hundred and eighty-three, and until the
said houses shall be completed and turned over to the said
directors.
4. To enable said directors to carry out the provisions of
this act, they shall have full power, from time to time, to
order and direct their treasurer to draw upon the treasurer
ot the commonwealth (which shall be audited by the auditor
of public accounts), for such sums of money as may be neces-
sary to defray the expenses of said building or buildings,
which shall be paid out of any money in the treasury not
otherwise appropriated: provided the whole expense shall not
exceed one hundred thousand dollars.
5. As soon as practicable, after the completion of the said
buildings, the directors of the Central lunatic asylum shall
cause to be removed from the present asylum buildings, at
Howard’s grove to the said buildings upon Hare’s farm, the
permanent asylum buildings, all of the state’s property then
upon the premises at Howard’s grove, necessary or proper
to be removed, and all the persons of unsound mind, inmates
of said asylum. And after such removal, the expenses of
maintaining the said asylum shall be provided for and paid
in the same manner that the expenses of similar institutions
in this commonwealth are provided for and paid. And the
powers, duties, and responsibilities of the directors of the
Central lunatic asylum, thus permanently located upon the
said site, in the county of Prince George, shall continue and
be the same as now provided by law, for the said directors,
as temporarily located at Howard's grove.
6. This act shall be in force from its passage. and all acts
or parts of acts in conflict herewith are hereby repealed.
