Chap. 224.—An ACT to amend and re-enact sections five of chapter
one hundred, Code of Virginia, 1873, in relation to fishing for ale-
wives.
Approved March 6, 1882.
1. Be it enacted by the general assembly of Virginia, That
sectior five of chapter one hundred, Code of Virginia, edition
of eighteen hundred and seventy-three, be amended and re-
enacted so as to read as follows:
§ 5. All citizens of the state of Virginia engaged in taking
or catching fish, known as alewives, for the purpose of manu-
facturing oil or manure, are hereby prohibited from taking
or catching fish within half-mile of the mouth of any river
or creek of this state, and are hereby permitted to take or
catch fish for said purpose only in Chesapeake bay: provided,
that they do not take fish for said purpose within half-mile
of shore of said bay: and provided further, that no fish shall
be taken for any purpose by or with boats propelled in whole
or in part by steam. No boats propelled in whole or in part
by steam sball be used for the purpose of towing or carrying
boats that are used for the purpose of taking fish.
2. Any person violating the provisions of this act shall,
upon conviction, be deemed guilty of a misdemeanor, and shall
forfeit his vessel, boat, or craft, and all purse-nets or seines used
in taking or catching such fish, and shall be fined not exceed-
ing one thousand dollars—one-fourth of which shall go to the
informer.
3. All acts and parts of acts inconsistent with this act are
hereby repealed; and this act shall be in force from its pas-
page.
