CHAP. 90.—An ACT in relation to the boundary line between Virginia and Maryland.
Approved April 2, 1879.
Whereas tle arbitrators appointed to ascertain the boundary
line between the states of Virginia and Maryland have filed
their award, which award has been ratified by said states, and
approved and accepted by the congress of the United States;
and whereas it 1s necessary that said boundary line shall be
marked and designated by suitable monuments, so that its pre-
cise location: may be accurately and readily ascertained by the
eitizens of each of the aforesaid states; therefore,
1, Be it enacted by the gencral assembly of Virginia, That
it shall be the duty of the governor to nominate and appoint a
commissioner, who, together with a commissioner or commis-
sioners to be appointed by the state of Maryland, shall, in con-
cert with each other, have the said line surveyed, and so far as
practicable and necessary shall have the same marked and de-
fined by suitable monuments ; and to the end that said line may
be run by persons of the highest skill, and as the sante is a
imatter of federal concern, the governor is directed to solicit
the war department at Washington to detail one or more of the
topographical engineers of the United States, who shall run and
mark and bound said line with such monuments to be placed
thereon of the kind, number and description that the said engi-
neer shall order and direct.
2. The commissioner above-named shall, as soon as the work
is completed, submit his report to the governor, and his com-
pensation shall be ascertained and allowed by the next general
assembly; but the auditor of publie accounts shall issue his
warrant on the treasury upon the certificate of the governor for
so much money as may be necessary to pay the current ex-
penses of the work contemplated in this act: provided that the
sums so expended shall not exceed the sum of three hundred
dollars appropriated by the act approved February twenty-five,
eighteen hundred and seventy-eight, and the additional sumof
one thousand five hundred dollars appropriated by the act ap-
proved March fourteen, eighteen hundred and seventy-cight,
entitled an act appropriating the public revenue for the fiscal!
year eighteen hundred and seventy-seven, seventy-elght.
3. The said warrants shall be drawn in favor of the commis-
sioner appointed under this act, and the said commissioner shall
disburse the same to those entitled thereto, of which disburse-
ment said commissioner shall keep an account and report with
vouchers to the governor when his work shall have been com-
pleted.
4. Before entering upon the discharge of his duties under
this act, the commissioner shall execute a bond payable to the
commonwealth of Virginia, in the sum of ten thousand dollars,
to be approved by the judge of the county wherein the said com-
missioner may reside, conditioned for the faithful discharge of
his duties, which bond, when so approved, shall be forwarded.
