CHAP. 8.—An ACT authorizing state depositories te substitute new
bonds for those executed under existing laws,
Approved March 28, 1879.
1. Be it enacted by the general assembly of Virginia, That
any bank now acting as state depository by authority of see-
tion twenty-five, chapter fifty-eight of the Code of cighteén
hundred and seventy-three, and which has procured to be en-
tered into in its behulf the bond in the penalty of five hundred
thousand dollars, as required by the provisions of the aforesaid
statute, may substitute in lieu thereof a new bond entered into
in its behalf by other persons than such bank, in the penalty
of one hundred thousand dollars, to be approved by the gov-
ernor, conditioned faithfully to account for and pay over the
amounts now on deposit to the credit of the commonwealth, or
such other sums as may hereafter be deposited with it, and con-
ditioned for the faithful discharge of the duties and obligations
pertaining to it as such depository. And upon the execution
and delivery of such new bond to the treasurer of the com-
monwealth, the old bond shall be delivered up to the bank for
cancellation. But the governor after being satisfied at any time
that the penalty of any such bond as may be substituted under
the provisions of this act is too small may, upon ten days’ no-
tice to the bank, require a new bond of like character, and in
such additional penalty as he may prescribe.
2. This act shall be in force from its passage.
