Chap. 64.—An ACT to regulate the fees of notaries and commis-
sionels in chancery.
Approved April 2, 1879
1. Be it enacted by the go-ne-al assembly of Virginia, That
sections four, five and nine of chapter one hundred “and eighty
of the Code of eighteen hundred and seventy-three be repealed.
2. Be it enacted, That a notary public shall receive, where
there is a protest by bim, fo: the record thereof, making out
instruments of protest unde” his official seal, and notice of dis-
honor to one person besides the maker of a note or acceptor of
a bill, fifty cents; for ever additional notice, five cents; for
taking and certifying the ack: rviedgment of any deed or writing,
or taking and certifying the privy acknowledgment of a married
woman, twenty-five cents; for administering and certifying an
oath, unless it be an affidavit of a witness, twenty cents; for
taking and certifying affidavits or depositions of witnesses,
when done in an hour, seventy cents, and for every additional
hour, seventy-five cents; for other services, same fees as clerks
of county courts for like services.
3d. Commissioners in chancery shall receive for like services
samme fees as notaries public, and for other services such fees
as the court by which the commissioner is appointed may from
time to time prescribe, not exceeding seventy-five ernts when
less than an hour is employed, and if more than an hour be em-
ployed, not exceeding the rate of seventy -five cents for each
hour: provided that “nothing contained in this act shall aifect
the fees of commissioners in chancery residing in the cities of
htichmond, Norfolk and Alexandria.
4. All acts and parts of acts in conflict with this act are
hereby repealed, and this act shall be in force trom its passage.
