CHAP. 46.—An ACT to amend and re-enact section 6 of chapter 100
of the Code of 1873, as amended by the act approved February 20,
1878, in relation to unlawful fishing.
Approved March 31, 1879.
1. Be it enacted by the general assembly, That section six,
chapter one hundred of the Code of eighteen hundred and
seventy-three, as amended and re-enacted by the act approved
March twenty, eighteen hundred and seventy-eight, be amended
and re-enacted to read as follows:
$6. Jt shall not be lawful for any person to fish im any of
the waters of this state within tide-water, with a purse not,
pound net, or fixed device of any kind, between sunset of
Saturday night of each week and sunrise of Monday of the
cusuing week; nor to fish with purse nets in the rivers and
creeks of the commonwealth, or within half a mile of the shore
of Chesapeake bay within the limits of Elizabeth City, Acco-
mac and Northampton; nor shall it be lawful to fish with any
purse net or pound net in any of the rivers of the common-
wealth, or within one mile of the mouth of any river, except
that the pound net may be used in the Pianketank river. And
provided that no pound net hereafter purchased or constructed
to be set in any of the waters of this state shall have meshes
Jess than one and one-half inches square. The bag, purse, or |
head of any pound net or other fixed device, shall, during the
time between the Saturday at sunset of one week, and sunrise
of the Monday of the following week, be taken up, so that the
fish may freely pass without obstruction. Any person violating
the provisions of this section shall be guilty of a misdemeanor,
and be fined not more than one hundred and fifty dollars.
2. All acts and parts of acts imconsistent with this act dre_
hereby repealed, but nothing in this act shall be construed to
amend or repeal the act approved February twenty seventh,
eighteen hundred and seventy-nine, entitled an act for the pro-
tection of fish in certain waters of the commonwealth.
3. This act shall be in force from the first day of June, eigh-
teen hundred and seventy-nine.
