CHAP. 31.—An ACT to amend and re-enact section 8, chapter 97, Code
of 1873, in relation to damages for trespasses by animals.
Approved March 31, 1879.
1. Be it enacted by the general assembly, That section eight,
chapter ninety-seven, Code of eighteen hundred and seventy-
three, be amended and re-enacted so as to read as follows:
§ 8. If any horses, cattle, hogs, sheep, or goats shall enter
into any grounds enclosed Ae a lawful fence, or into any grounds
in counties or districts where the boundary _lines of lots or
tracts have been constituted lawful fences, the owner or manager
of any such animal shall be liable for every such entry to a
fine of not less than one nor more than twenty dollars, to be
recoverable on warrant before a justice of the peace, and in ad-
dition shall be liable to the owner of such grounds for any
damages ;,and for every succeeding trespass by such animal,
the owner thereof shall be liable to any person whose grounds
are enclosed by such a fence as is mentioned in section one of
this chapter for double damages, and after having given at
least five days’ notice to the owner or manager of said animal
of the fact of two previous trespasses, the owner or occupier
of such grounds shall be entitled to such animal if it be found
again trespassing on the said grounds.
2. This act shall be in force from its passage.
