CHAP. 28.—An ACT to incorporate the Roxboro’, Leasburg and Dan-
. Ville ‘Turnpike Company.
Approved March 31, 1879.
1. Be it enacted by the general assembly, That it shall be
lawful for W. N. Shelton, W. T. Sutherlin, John B. Anderson,
W. W. Worsham, F. X. Burton, FE. F. Acree, J. G. Penn, T. L.
Poindexter, G. C. Agus, T. J. Talbott, John R. Pace, J. R.
McCully, A. G. Walters, A. J. Clark, and A. E. Walters, or any
five of them, to open books of subscription te the capital stock of
the Roxboro’, Leasburg and Danyille turnpike company, at such
times and places as they may determine upon. And whenever
five hundred dollars shall have been subscribed, the subscribers
may organize the company, and thenceforth they, and such per-
sons as shall afterwards be associated with them, shall be a cor-
poration under the name and style of The Roxboro’, Leasburg
and Danville Turnpike Company, and under said name of Rox-
boro’, Leasburg and Danville turnpike company, shall have
power to sue and be sued, plead and be impleaded, for the pur-
pose of constructing a turnpike from the city of Danville, Vir-
ginia, at or near the eastern terminus of Monument street, in
said city, to the North Carolina line, at or near Walter’s miil ;
and shall be subject to all the provisions of the Code of Vir-
ginia applicable to turnpike companies, and not inconsistent
with the provisions of this act.
2. The capital stock of said company shall not be less than
five hundred nor more than ten thousand dollars, to be divided
into shares of ten dollars each, and the stockholders shall be
entitled to one vote for each share of stock owned by them in
all meetings of the stockholders. Subscriptions to the capital
stock of said company may be made by individuals, counties,
cities or towns, in money, credits, labor or material.
3. The persons herein named, or any five of them, whenever
five hundred dollars has been subscribed, may, by publication
for ten days in a newspaper published in the city of Danville.
call a meeting of the subscribers, who shall in general meeting
proceed to organize the company by the election of a president
and four directors; and the president and directors so elected,
shall have control of all the operations and business of the
company, and appoint such officers as they may deem necessary
for the management of its affairs, subject to such by-laws as
the company may adopt; but no subscriber shall vote at the
organization of the company who has not paid twenty per cen-
tum on his stock.
4. Whenever the company and the land-owners cannot agree
upon the price to be paid for the land along the line of said
turnpike, commissioners shall be appointed as provided by law,
to ascertain the value of same, according to law.
5. The width of said turnpike shall be twenty feet, and when
completed, it shall be lawful for said company to erect toll gates
and charge toll thereon, as prescrided in Code of eighteen hun-
dred and seventy-three, chapter sixty-one, sections thirteen and
fourteen.
6. It shall be lawful, with the consent of the state of North
Carolina, for the company organized under this charter to ex-
tend its turnpike into the state of North Carolina at or near
Leasburg.
7. This act shall be in force from its passage.
