Chap. 1.—An ACT concerning the town of Newtown-Stephens-
burg, Frederick county, Virginia.
Approved March 17, 1879.
1. Be it enacted by the general assembly of Virginia, That
the corporate limits and boundaries of the town of Newtown-
Stephensburg, Frederick county, Virginia, shall be and remain
as they now are, and have heretofore been established by law ;
and be called and constitute The Town of Newtown-Stephens-
burg.
2. The municipal authorities of said town shall consist of a
mayor and four councilmen, who shall be elected annually by
ballot, on the fourth Monday in March, at some convenient
place in said town by the freeholders and housekeepers resident
in said town, and who shall be themselves residents and free-
holders in said town, and shall hold their offices for one year
from the fourth of March in each year, and until their succes-
sors be elected and duly qualified in office. The mayor and
councilmen shall each, before entering upon the duties of office,
take an oath or affirmation before a justice of the peace for the
county of Frederick, that he will faithfully and impartially, to
the best of his judgment, perform the duties of his office.
3. Lhe mayor and council, so elected, (any three of whom
shall constitute a quorum), shall have power to make by-laws
and ordinances for the regulation and good government of the
said town, and to assess and collect taxes on the inhabitants
and property within the limits of the said town for the charge
of repairing, opening or cleaning the streets and other muni-
cipal purposes, subject to the limitations and restrictions of the
general law of the state, regulating towns as contained in chap-
ter fifty-four, Code eighteen hundred and seventy-three.
4. The mayor and council, so elected, shall elect by ballot,
and appoint a town sergeant, who shall, within the limits of
the said town, and within one mile ciysumjacent thereto, be a
conservator of the peace, and bave all the powers and duties of
a constable to execute the ordmances and regulations of the
said town, and be removable from office by the mayor. The
mayor and councilmen, so elected, shall be ex-officio conserva-
tors of the peace, whose policial jurisdiction shall extend within
the limits of the said town, and for one mile circumjacent
thereto; and the mayor shall have power and jurisdiction to
hear and determine all questions of breach of the peace, sub-
ject to the right of appeal as prescribed by law, and of breach
or violation of the ordinances and regulations of the said town,
and to impose and enforce the collection of fines and penalties
therefor, subject to the general law of towns as contained in
chapter fifty-four of the Code of eighteen hundred and seventy-
three.
5. In the event of the death, resignation or removal out of
‘the said town of any of the said mayor and councilmen, such
vacancy shall be supplied, within twenty days, by the election
as aforesaid, of the freeholders and housekeepers of said town.
6. The said municipal authorities of said town of Newtown-
Stephensburg shall have the use ef the jail of the county of
Frederick, in the execution and enforcement of their duties of
office under this act, and by the general Jaws of the common-
wealth regulating the same,
7. All acts or parts of acts inconsistent with the provisions
of this act, are hereby repealed. |
8. This act shall be in force from its passage.
