CHAP. 273.—An ACT to authorize the legally qualified voters of the
county of Augusta to empower the supervisors of said county to
‘borrow money for the purpose of macadamizing certain public
roads in said county.
Approved March 9, 1880.
1. Be it enacted by the general assembly, That the board of
supervisors of Augusta county be and they are hereby directed
to borrow one hundred thousand dollars for the purpose of
improving and macadamizing such of the roads of the county
leading to Staunton as, in their opinion, should be improved
and macadamized.
2. Said board of supervisors shall issue the bonds of th
county for said amount in denominations of one hundred dol
lars and multiples thereof; said bonds to be coupons and tc
fall due twenty years after their date, but to be redeemable at the
option of said board of supervisors after the expiration of twe
years from their date, bearing interest at the rate of six pel
centum per annum—the interest to be payable annually at the
office of the treasurer of Augusta county. Said bonds shall be
signed by the chairman of the board of supervisors, and be
attested by the clerk of said board, and shall have the seal ot
said board affixed thereto, and the faith and property of: the
county of Augusta are pledged for the prompt payment of the
principal and interest of said bonds.
3. Said board of supervisors may at any time indicate to the
county court in writing what changes in grades and location
they may deem expedient upon any of said leading roads;
whereupon said court, on its own motion, shall appoint three
or more viewers to view the same, after which proceeding shall
be had thereon in accordance with the existing road laws of
this state.
4, All work done under and by virtue of this act shali be
¢ done under the supervision of said board or its successors and
at the expense of the county, to be paid from the proceeds of
the sale of said bonds, except as to expense attending the
changes in locatien of roads, which shall be paid for as now
provided by law.
5. Said board and its successors are hereby authorized to
purchase such machinery, implements and materials as they
may deem necessary, in order to carry out the provisions of
this act, and to employ as many hands and bosses, and at such
prices as they may deem proper; and are also empowered to
employ one competent engineer or surveyor at a salary not to
exceed five dollars per day for time actually employed.
6. The said bonds, when duly signed, attested and sealed, as
’ hereinbefore provided for, shall be delivered to the treasurer of
the county, who shall sell the same at not less than the full
value thereof. And for the proceeds of the sales of said bonds
and the proper disbursement and safe-keeping thereof, and for
the ‘proper collection, safe-keeping and disbursement of the
levies thereafter provided for, the said treasurer shall be liable
1 upon his official bond as for other county levies. And a com-
mission of one per centum shall be allowed said treasurer for
the sale of said bonds and disbursement of the proceeds there-
of; and the moneys received by the treasurer from sales of
said bonds shall be paid out by him upon warrants drawn by
order of the board of supervisors.
7. The said board, at its annual meetings for laying the
t county levy, shall levy a tax upon such subjects as are or may
- be liable by law for the county levy for an amount sufficient to
pay the annual interest, and not less than five hundred dollars
of the principal, which shall be collected by the treasurer of
Augusta county as other county levies are collected, and for re-
seiving and disbursing the same, said treasurer shall receive C
she same compensation as is allowed by law for receiving and °
Lisbursing other county levies.
8. The said board of supervisors shall provide by a system x
of tolls, to be regulated by them, for the necessary repairs of P
said leading roads: provided, the rates of toll shall not be r
yreater than is necessary to cover the expense of the necessary
repairs of the said roads as aforesaid.
9. All necessary powers for the carrying out of the provi-n
sions of this act are hereby conferred upon said board of f,
Supervisors. b
10. It shall be the duty of the several officers conducting F
elections in the county of Augusta, at the time and places for °
holding the general elections on the fourth Thursday of May,
eighteen hundred and eighty , to open a poll to take the
sense of the qualified voters of said county who shall desire to
vote upon the question of improving and macadamizing said
roads. The ballots shall be respectively as follows: ‘For the fF
road law,” or “Against the road law.” Each ballot so cast
which shall have written or printed thereon “For the road ;
law” shall be taken and counted as a vote for improving and
macadamizing said roads; and each ballot so cast which shall
have written or printed thereon “ Against the road law” shall
be taken ahd counted as a vote against improving and mac-
adamizing said roads. The manner of receiving and canvassing b
the ballots cast at such election on the question of improving ¢ c
and macadamizing said roads, and making returns and ab- Pb
stracts of the results thereof, shall conform in all respects to
the regulations prescribed by the general election law of this
state, except that the certificate of the judges of election shall
be as follows:
We hereby certify that at the election held _— I
votes were cast for the road law, and votes were cast *
against the road law.

And provided further, that the commissioners of election
shall make, on a separate sheet, an abstract of said votes for
and against the improving and macadamizing said roads of
said county, which abstract shall be duly signed by the said
commissioners and deposited in the office of the clerk of the
county court of said county. If, from such returns and ab- \
stracts of the votes so cast upon the question of improving ¢
and macadamizing the said roads of Augusta county, it shall v
appear that a two-thirds majority of the votes cast were far
improving and macadamizing said roads, then the said board
of supervisors shall proceed to carry out the provisions of this
act as hereinbefore provided for; but if two-thirds of the vote
so cast be not for improving and macadamizing said roads
then this act shall be inoperative.
11. This act shall be in force from its passage.
