CHAP. 218.—An ACT authorizing and directing the Auditor of Pub-
lic Accounts to collect the sum of one hundred dollars, paid to the
Sheriff of Wythe county by Alonzo Grinnell, surety of Alexander
Corvin, indicted for felony upon a forfeited recognizance, and to
refund the same to the said Alonzo Grinnell when so collected, and
releasing the said Grinnell from the payment of twenty-five dollars,
balance of said judgment.

Whercas a judgment of the circuit court of Wythe county
was rendered on the fifteenth day of September, eighteen hun-
dred and seventy-four, against Alonzo Grinnell for one hundred
and twenty-five dollars, upon a scire facias sued out upon a
forfeited recognizance as surety for Alexander Corvin, who
was indicted for felony, and the said Alonzo Grinnell having
paid to E. H. Umberger, sheriff of the said county of Wythe,
the sum of one hundred dollars in part payment of said judg-
ment; and whereas at a circuit court held for the county of
Wythe, on the fourteenth day of September, eighteen hundred
and seventy-five, a nolle prosequi was entered against the de-
fendant Alexander Corvin, indicted for felony as aforesaid, for
whose appearance the said Alonzo Grinnell was surety in the
said recognizance; therefore,
1. Be it enacted by the general assembly, That the auditor
of public accounts be and he is hereby authorized and directed
to proceed to collect from the said sheriff of Wythe county the
one hundred dollars so paid to him by the said Alonzo Grinnell
on account of the judgment aforesaid, and that when the same
shall be collected and paid into the treasury the said auditor
of public accounts shall issue his warrant on the treasurer,
payable out of any money in the treasury not otherwise appro-
priated, in favor of the said Alonzo Grinnell, for the sum of
one hundred dollars, refunding to him the amount so paid by
him on account of said judgment.
2. Be it further enacted, That the sum of twenty-five dollars,
the balance of the said judgment on said forfeited recognizance,
is hereby released, and the said Alonzo Grinnell forever dis-
charged from the payment of the same.
8. This act shall be in force from its passage.
