CHAP. 185.—An ACT to amend and consolidate into one act the laws
prescribing the manner in which the public printing shall be exe-
cuted, and defining the duties of the superintendent thereof.
Approved March 4, 1880.
1. Be it enacted by the general assembly, That the public
printing and binding of the commonwealth shall be under the
supervision and management of the superintendent elected
under the provisions of section one, chapter seventeenth, of
the Code of Virginia, edition of eighteen hundred and seventy-
three, and the manner of its execution and the duties of said
superintendent shall be as herein prescribed.
2. Before entering upon his duties the superintendent shall,
in addition to the oaths required by law to be taken by other
officers of the commonwealth, take an oath that he is a practical
printer, and is skilled in and acquainted with the details of
the business of printing; that he will not be in any manner,
directly or indirectly, interested in the contraets for the print-
ing, binding, lithographing and engraving to be let out by him,
or in any contract for stationery purchased for the use of the
state, and that he will not participate in the use of the profits
arising from the same. If he in any manner, directly or indi-
rectly, violate the provisions of this section, he shall be deemed
guilty of a misdemeanor, and be prosecuted therefor; and if
convicted, shall be fined not less than five hundred nor more
than one thousand dollars, and be confined in jail not less than
six nor more than twelve months.
3. He shall keep the following books: a letter-book, in which
he shall keep his official correspondence; a record-book, which
shall exhibit in brief all accounts for stationery, printing,
binding, lithographing and engraving, and a record of all his
official transactions; a contract-book, in which he shall enter
all contracts and bonds; and a schedule-book, exhibiting in
detail the cost of all printing, binding, lithographing and
engraving executed for each department of the state govern-
ment, which books shall at all times be open to the inspection
of the governor and any member .of the general assembly.
4. He shall let out to the lowest responsible bidder, experi-
ence and facilites possessed at the time of bidding consid-
ered, (which shall be determined, in case of appeal, during the
sessions of the general assembly, by the joint committee on
public printing, and during vacation by the governor, secretary
of the commonwealth and auditor of public accounts), all the
printing, binding, lithographing and engraving required by any
department of the state, and authorized by law to be done, or
required in the execution of any law. He may let out the
printing and binding to different persons, and at such times
and in such lots or portions as he may deem proper. In every
case he shall require the party undertaking to do the work, or
any part of it, to enter into a written contract, stating dis-
tinctly the terms of the same, embracing the prices to be paid
for composition, press-work, folding, stitching, binding and all

other items in detail; and always providing in such contract
for printing that it is to be executed in a close and compact
form, without unnecessary title pages or useless blank pages.
He shall also take from the person or persons making such
contract, bond with security, to be approved by and filed with
the secretary of the commonwealth, in a penalty of at least
double the aggregate amount of the work contracted for, and
conditioned for the faithful performance and execution of such
contract. No printing or binding for the general or law libra-
ries shall be paid out of the fund appropriated for public
printing, except such as is specially provided for by law.
5. As soon as the annual reports of institutions and officers
of the commonwealth are received they shall be delivered by
the officer to whom they are required to be made, at once, to
the superintendent of public printing, whose duty it shall be
to have five hundred copies thereof printed, in octavo form,
and bound together, and be distributed by him amongst the
members of the general assembly and the heads of depart-
ments; and five copies shall be furnished by him to each insti-
tution or officer, twelve copies to the library, ten copies to the
clerk of each house for the use of their respective houses, and
sixty copies shall be disposed of as the executive may direct,
and the rest shall be a part of the library fund. The reports
of the board of public works shall be bound in a separate
volume from the reports above provided for, but the same
number of copies and the same manner of distribution shall
be adhered to. It shall be the duty of the superintendent to

bution on the first day of each regular session of the general
assembly: provided, the same shall be placed in his hands by
the twentieth day of the preceding October.
6. He shall cause to be printed, in octavo form, five hundred
copies each of the journals of the Senate and House of Dele-
gates, and a like number of each document ordered by either
house of the general assembly, two hundred copies of which
shall be distributed from time to time, as they are printed,
amongst the members and heads of departments. The remain-
ing three hundred copies of the journals and documents of
each house, with an index thereto, shall be half-bound, and
distributed by the superintendent of public printing as follows:
One copy to each member of the general assembly and the
heads of departments, five copies to the clerk of each house,
and the remainder to the state librarian, of which fifteen
copies shall be kept in the library, sixty shall be disposed of
as the executive may direct, and the balance shall be a part of
the library fund.
7. He shall cause to be printed, in octavo form, two hundred
and fifty copies of every bill, joint resolution, or other matter
ordered to be printed for the use of the Senate or House of
Delegates, and intended for temporary use; and in all fugitive
work, such as “resolutions,” ‘joint resolutions,” ‘ House or
Senate bills,’ there shall not be allowed in bills or resolutions
making more than one page, on the first page thereof, between
the folio line and the first line of the enacting clause, which
said space shall include the heading “a bill,” or ‘resolution,’
or “joint resolution,” the title to the same, the name of the
patron, the report of the committee or committal thereto, an
amount of space in excess of three inches, unless the title to
the same shall be in excess of three lines, in which case the
space in excess of three inches shall be no more than is neces-
sary to contain said additional lines to the title; and in all
book or pamphlet printing, except bills, there shall not be
allowed thicker leads or spaces between the lines than five-to-
pica.
8. He shall cause to be printed, in octavo form, as soon as
approved by the governor, seven thousand copies of the acts
and joint resolutions of the general assembly, and shall dis-
tribute them as follows: five copies to each member of the
general assembly and to the clerk of each house, and one copy
to each head of department and judge in the state from time to
time as they are printed, and as soon as practicable after the
end of each session he shall forward by mail or express, or
otherwise, ten half-bound copies to each member of the gen-
eral assembly, and deliver one copy to each head of depart-
ment; to every judge two copies; one copy to each justice of
the peace, mayor and clerk of any court, to every attorney for
the commonwealth, and to every sheriff, sergeant, treasurer,
supervisor, commissioner of the revenue, superintendent of
public schools; one copy to every judge and clerk of any
court held in this state under the laws of the United States,
and to each attorney and marshal holding office under the laws
of the United States, five copies for the general library, and
five copies to the law library, one copy to the university,
one to each college within the state, one to the hoard of
directors of each of the lunatic asylums, one to the Deaf and
Dumb and Blind Institution, one to the Virginia Military Insti-
tute, and ten copies to the clerk of the Scnate for the use of
the Senate, and fifteen copies to the clerk of the House of Del-
egates for the use of the Honse; he shall deliver to the secre-
tary of the commonwealth the copies remaining on hand after
the distribution above provided for, to constitute a part of the
library fund.
9. He shall cause to be published in such newspaper, or
papers, as may be ordered, proclamations and advertisements
from the executive, treasurer, either auditor. register, attorney-
general, board of public works and clerk of either house of
the general assembly.
10. He shall purchase from the lowest responsible bidder (to
be determined in case of appeal, during the sessions of the
general assembly, by the joint committee on public printing,
and during the vacation by the governor, secretary of the com-
monwealth and treasurer) all the stationery needed for the
printing and binding let out by him, and furnish the same to
the printer as‘it may be needed; the accounts for the purchase
of which, certified by him to be correct, shall be presented by

which department, and the cost of all advertising, printing,
binding, lithographing and engraving.
Authority of 14. The joint committee on printing shall have authority to
joint com- —_ supervise and give directions in all that relates to the public
printing printing and binding. They shall, at their option, make report
to the general assembly of any matter by them deemed per-
tinent.
Porter al- 15. The superintendent of public printing is hereby author-
Balaey ized to employ a porter at a salary not exceeding twenty-five
dollars per month. The auditor of public accounts is hereby
authorized and required to issue his warrant monthly on the
treasury, upon the certificate of the superintendent of public
printing, for the pay of said porter.
‘Ch. 19, Code 16. Chapter nineteen of the Code of Virginia (edition of
1873, repealed eighteen hundred and seventy-three), and all acts inconsistent
herewith, are hereby repealed.
