CHAP. 166.—An ACT to prohibit non-residents taking fish in the
waters of Virginia.
Approved March 4, 1880.
1. Be it enacted by the general assembly of Virginia, That
if any person or persons, not residents of this state, shall take
or catch fish in any of the waters thereof in any other way
than by a line, rod or pole held in the hand, he or they skall
be deemed guilty of a misdemeanor, and pay a fine of not less
than two hundred nor more than three hundred dollars, and
forfeit his or their vessel and fishing apparatus of whatever
kind; and on failure to pay such fine he or they shall be im-
prisoned in the county jail not less than two months.
2. Any person wishing to fish with a pound-net, fyke or weir
within the waters of this state shall obtain a license from the
clerk of the county court of the county wherein he wishes to
fish, and shall swear or affirm before said clerk that he has
been a resident twelve months next preceding such applica-
tion; that he will not engage in takingseér catching fish with
any non-resident with said pound-net, fyke or weir, or that
any non-resident shall have any interest, in whole or in part,
with him, directly or indirectly, in such fishing; that there is
no lien on such pound-net, fyke or weir held by non-residents ;
that such pound-net, fyke or weir are not held by agreement
or intention to return them at any subsequent time to any non-
resident, and that they will not violate any of the laws regu-
lating and controlling the taking or catching of fish within the
waters of the state. Any person violating this section shall
pay a fine of one hundred dollars, and forfeit his boat, nets,
fyke and weir, and receive the punishment under the law for
perjury. One-half of the above fines and penalties shall go to
the informer: provided, that for the purpose of enforcing this act,
when any river lies between any counties situated on the tidal
waters of this commonwealth, the courts for the counties on
each side respectively shall have concurrent jurisdiction over
all parts of the said adjacent river or water-course in all cases
where violation of this act may come in question; and the
courts for counties lying on the waters bounding the state shall
have jurisdiction respectively over such waters so far as the
jurisdiction of this state extends. But this act shall not be
construed to affect the general jurisdiction of the courts of
counties as defined in section two of chapter one hundred and
fifty-seven of the Code of Virginia in any manner except as
defined herein.
3. This act shall be in force from its passage. All acts and
parts of acts inconsistent with this act are hereby repealed.
