Chap. 118.—An ACT for the relief of the sureties of William E.
Boisseau, late sergeant of the town of Danville.

Whereas a judgment was recovered on the sixteenth day of
December, eighteen hundred and seventy-nine, in the circuit
court of the city of Richmond by the commonwealth of Vir-
ginia against William E. Boisseau, late sergeant of the town
of Danville, and against Berryman Green, David Ayers, Lewis
A. Yates, James Wood and B. II. Boisseau, his sureties on the
official bond of said sergeant for the sum of thirty thousand
dollars, being the full penalty of the official bond of the said
sergeant, to be discharged by the payment of the following
sums, not exceeding the aforesaid sum of thirty thousand dol-
lars, to-wit: eight thousand, one hundred and eleven dollars
and twenty cents with interest at the rate of twelve per centum
per annum from the first day of May, eighteen hundred and
seventy-eight, till paid, being the balance for fees for Moffett
registers and the tax on registered sales of liquor for the year
ending thirtieth of April, eighteen hundred and seventy-eight,
and the sum of sixteen thousand, one hundred and fifty-eight
dollars and seventy-one cents with interest thereon at six per
centum per annum from the first day of May, eighteen hundred
and seventy-nine, till paid, being the balance of fees for Mof-
fett registers and the tax on the sales of liquor, and the liquor
licenses, taxes for the year ending thirtieth of April, eigh-
teen hundred and seventy-nine, and also the sum of nine-
teen thousand, ‘eight hundred and twenty-three dollars and
twenty cents, with interest from the fifteenth day of June,
eighteen hundred and seventy-nine, till paid, being bal-
ance of the land, property and capitation tax of eigh-
teen hundred and seventy-eight, and the sum of five thou-
sand, two hundred and forty-five dollars and thirty-four
cents with interest at six per centum per annum from
the first day of July, eighteen hundred and seventy-nine,
till paid, being the balance of fees for Moffett registers and
the tax on registered sales on liquor, and the licenses, taxes
for the year ending thirtieth of June, eighteen hundred and
seventy-nine, subject to the following credits, namely: five
thousand, six hundred and nine dollars and thirteen cents
paid by the said William E. Boisseau twenty-sixth of Sep-
tember, eighteen hundred and seventy-nine; four thousand,
five hundred and eighty-five dollars and five cents paid twenty-
seventh of September, eighteen hundred and seventy-nine;
two thousand dollars paid thirtieth September, eighteen hun-
dred and seventy-nine; one thousand, four hundred and eighty-
seven dollars and eighty-six cents paid October the fourth,
eighteen hundred and seventy-nine; and one thousand, seven
hundred and thirteen dollars paid the sixteenth of December,
eighteen hundred and seventy-nine; and that it further ap-
pears that the chief part of the defalcation on the part of
said Sergeant William E. Boisseau occurred during the latter
term, for which he did not qualify nor give a new bond, and,
also, that it further appears that the said sum of thirty thou-
sand dollars cannot be recovered of said sureties owing to the
insolvency of a part thereof; therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts be and he is hereby authorized
and required to accept from the said sureties peeler or consol
bonds of the state of Virginia at their par or face value in
payment or satisfaction of the balance due on said judgment
after the proceeds of the property of the said William E. Bois-
seau liable for the said judgment and the proceeds of all trust
property conveyed by the said William E. Boisseau for the in-
demnity of his said sureties shall have been applied to the
said judgment, in whole or in part: provided, that nothing
herein contained shall be construed to discharge the said Wil-
liam E. Boisseau from the payment of the full amount of the
said judgment which shall be credited as to him with only the
market value of the bonds so accepted at.the time of their
delivery to the auditor: and provided also, that the said sure-
ties shall be liable as amongst themselves for contribution
according to the amounts paid by them: and provided also,
that the bonds aforesaid shall be delivered. to the said auditor
within twelve months after the balance due on said judgment
is ascertained as above required. |
