CHAP. 108.—An ACT to amend section 1, chapter 147, Code of 1873,
in relation to the jurisdiction of justices.

1. Be it enacted by the general assembly of Virginia, That
section one of chapter one hundred and forty-seven of the
Code of (1873) eighteen hundred and seventy-three, be amended
and re-enacted so as to read as follows:
§1. Any claim to property or to any debt, fine or other Juris
money which would be recoverable by action at law or suit in (38
equity, shall, when the claim is to a fine, if the amount be lim- does
ited to an amount not exceeding twenty dollars, and in other dolla
cases if the claim be not of greater value or amount than one unos
hundred dollars ‘exclusive of interest), be cognizable by a Rots
justice, and even if the claim be for or against the town or than
county in which such justice resides; but in every case where inne
the sum or thing in controversy exceeds the amount or value town
of twenty dollars, the justice shall, upon the application of the [yic
defendant, at any time before trial, remove the cause to the Besla
court of the county or corporation wherein the same shall be reme
brought, and the clerk of said court shall docket the same, and cour
it shall be proceeded in as if. it were a motion in said court Clert
under the sixth section of chapter one hundred and sixty-three, $0¢*
of which the notice was docketed, at the time such case is so
docketed.
